A proposal for an alternative to the present W.C.A.

With ATOS Healthcare on the brink of bankruptcy and failing to meet the demands of their contract with the DWP it is essential we have a plan “B” which we can put forward for consideration upon their demise. I have written and spoken about such a plan many times and consider it to be of the utmost importance that the new test is designed by the people it is likely to affect most, the sick and disabled.

In the past the sickness benefits system has been abused, we are all agreed on that point. This is endemic in any form of Government benefit just look at the M.P.’s expenses scandal as a prime example of how easy it is to take more than you give. In designing a new test one must be as careful as is reasonably practicable to prevent fraud and in doing so being equally cautious in not excluding people who are legally entitled to benefits in the process.

Bearing the aforementioned in mind it is quite obvious a “test” of sickness / disability is necessary. The present biased system is grossly unfair and there are many cases of a Physiotherapists opinions on a persons functional ability being the preferred source of evidence by Jobcentreplus Decision Makers, when other evidence from eminent physicians is also available.

The problems associated with ATOS gel around the following facts.

They are a private sector company.

They employ, train and accredit their own Healthcare Professionals.

The I.T. basedLiMAsystem in not fit for purpose

HCP’s often lacked empathy with their clients.

Physically and mentally ill people were treated as “customers” rather than patients.

ATOS Healthcare could not make up their mind whether the assessment was a “medical” or a “functional assessment”.

The location and layout of medical examination centres are not “disabled” friendly, often in hard to reach places in City centres far away from parking and public service stops.

These facts and many other anomalies led to poor, rushed, assessments being made which in turn resulted in poor reports being produced. When faced with the report from the ATOS HCP, Jobcentreplus Decision Makers felt they were out of their depth in making decisions on the clients entitlement to benefits and simply “rubber stamped” the ATOS H.C.P.’s decision agreeing exactly on points awarded. This in turn led to countless “reconsideration” requests during which the “customer” got access to the H.C.P.’s report upon which the JC+ D.M. based their decision. In  every case the “customer” felt the report was about someone else and bore little or no resemblance to what had actually been said or occurred at the “medical”.

Consequently decisions were upheld by JC+ D.M.’s who shunned their responsibility and passed the file to the Tribunals Service. This led to enormous back ups in the Tribunals Service and the time to have a case heard extended up to 12 to 14 months in many cases. To combat the backlog and to “massage” the figures JC+ D.M.’s and ATOS H.C.P.’s were allowed to “review” files held by the Tribunals Service. This mysterious turn of events led to many claimants receiving letters saying their case had been “reviewed” and a new decision made in their favour, thus negating the need to attend a tribunal. Whilst this did shorten the queue slightly, it did little for the reputation of ATOS, the D.W.P. and the Tribunal Service.Whilst this was going on, the Government commissioned the “Harrington report” which was allegedly tasked with “looking” at the Work Capability Assessment and identifying areas where improvements could be made. Professor Harrington looked at the present system, found it to be seriously flawed and made several recommendations.

To date very few “recommendations” have been implemented and both ATOS and the Government admit the proposed adjustments are taking longer and proving more difficult to implement than first thought. Prof Harrington admitted his recommendations have not been implemented and would take time to come through the existing system, even when asked what would happen to those who had their benefits suspended because these recommendations were not implemented in time. 

Having summed up the available evidence I now come to my original point. What is the alternative? Thousands of us are complaining about the treatment we have received from ATOS and about the apparent lack of empathy they have with their clients. We all agree there is something fundamentally wrong with an assessment system which relies upon a private company for delivery to decide who is and isn’t fit for work, when their main function as a private sector company is to make profit!

 I offer the following for your consideration.

 Plan “B”

Any proposed replacement scheme must be delivered by a not for profit organisation like the NHS.

Any assessment must be fair and equitable. It must provide an opinion upon the effect sickness/disability has upon an individual’s ability to perform work related tasks within their own skill set. (Not, as at present “any” kind of work the HCP can imagine)

The client must be referred to as the Patient rather than words like “client, claimant or customer”.

A suitable and easy to understand questionnaire should be designed and an accompanying set of descriptors to clarify each question made available to the patient prior to a decision being made regarding a medical assessment taking place.

Time limited appointments should be made to avoid extended waiting times. Medicals should have a specific duration where possible and should be based upon the information available in the medical questionnaire.

All “medicals” should be carried out by fully qualified medical personnel with experience of general practice and who are employed by the N.H.S.

Evidence from the patients G.P. or other medical professional should be the basis of the examination and used to “filter” terminal cases at the earliest possible point, whilst allowing the processes to inform those who are required to attend, to do so.

All medical centres should have safe access and egress for disabled people and have reception, waiting rooms and examination rooms on the ground floor. All areas should be well lit, have windows, be well ventilated and have comfortable seating. Refreshments and suitable reading material should be present and available rather than the present poorly seated, with 4 bare walls, cramped and dimly lit conditions claimants have to endure at present.

The test must be able to recognise short, medium or long term effects and the length of these periods be clearly defined. This would allow the Doctor to make a recommendation on when the patient is likely to recover or not whichever the case may be. It would also allow for pre planned follow up examinations to assess progress, either way.

The Doctor should have the full facilities to further examine the patient available to him including x-ray, MRI scanners, Specialists in physical and mental health conditions etc to ensure a fair test is delivered. Doctors should be able to rearrange an examination after further tests should this be necessary, however, being employed by the NHS access to patients records would be an essential part of the process.

Jobcentreplus Decision Makers should remain involved with the process however, appropriate training should be given to ensure fair and equitable processes. This should include the automatic search for further evidence from medical professionals connected to the claimant by the DM.

It is essential that all evidence is considered carefully in the decision making process and that the claimant is informed of the decision quickly and in sufficient time to react, rather than finding out they have failed their medical on the day their benefits should have been paid to them.

Jobcentreplus should ensure reconsiderations are dealt with quickly and within a reasonable time i.e. 2 weeks. The present system can lead to increasing debt and stress to the claimant who in some cases may become homeless.

Jobcentreplus need to take a more sympathetic approach to claimants and wherever possible assist rather than hinder progress.

My only concern is we are prepared if the question “What would you do”? is asked.

The problem I can see here is the N.H.S. they have limited resources as it is now and this would cost serious money with CT scans, M.R.I. etc I think we are getting sucked into fghting on their terms ie this is all about false claims, it is nothing to do with false claims and further more I beleive this is fit for purpose the purpose being to get x amount of people off disabilty benefits making a pre-determend saving in money with the goverments knowledge and blessing. The problem is evil people trying to save money over the bodies of the poorest and weakest people in society while allowing rich people to avoid tax and build up vast fortunes. I have suffered years of treatment been poked and prodded to prove my illness well fuck that I am tried, depressed and on the edge, fuck them and fuck the fact they are alowed to do it with no punishment.

  2. Limpimp…There’s Mr Hester of the Royal bank of Scotland getting a bonus of 900,000 pounds, that’s nearly a million pounds for failure, a bank that is 81% owned by the British taxpayer, who promised to help small business and therefore help people in to work, he failed but he is rewarded.

  3. I think I kind of understand where you are coming from either there must still be money about and they are just fucking us or they are complete dickheads with no idea?

    I have been doing a bit of thinking and research on this and a video on youtube (http://www.youtube.com/watch?v=ce03wVyddCY) upset me a bit. They are using sanctions to remove people from JSA for months at a time in an orchestrated way telling staff they are “saving the country money” I know a bit about how these government departments work and they like to breed an attitude of them and us to make the job personal.

    There has been kind of eureka moment for politics through misfortune or design. A problem comes along, say terrorism… terrible! scary!, what can we do? Tell everyone how terrible and scary it is how their lives are at risk and everyone they love could be at risk. What can we do? we ask. The newspapers speculate on the next big attack, everyone gets worried. The government say “this is serious we need more legislation”, “stronger laws” the ability to take “tougher action” against these people, nasty people. They don’t state what, but it includes scanning all emails, all text messages p2p messenger programs they should take all your biometric details and if anyone says hang on what, why? they say well it’s very serious we need to do this so Mr terrorist doesn’t kill you all as you sleep. Middle England says oooo ahhh thanks sir.

    Now you may ask where do we come in, but hang on use the same template change terrorism for global downturn and you can use the template for social engineering to your governments taste. Must be really sad if you are nice and rich and want to live in a nice hip up and coming area of London and it’s full of all these dirty poor people that have the cheek to have lived there all along before it was hip and trendy. How can we move them to somewhere more in keeping with their look? Well look at all these dirty scroungers living in “multi million pound houses”, nasty people, maybe we should limit their housing benefit or rent so they have to go somewhere cheaper freeing those big old houses for someone that they suit. What? Why? say some well if we don’t the global downturn will mean we all explode.

    You release stories into the papers about all these scroungers with blisters that are getting free Mercedes and trips to the Caribbean. How we need to save money because of the global downturn 80% are false claims you know blah, blah, fucking blah. It is such a good method turning your neighbour against you (been used before as I recall) even we start saying “ah yes I agree we need to stop these scroungers, I am not one of them please believe me” “test me, test me” well I have been tested multiple times it is never enough because they want me in my place the gutter.

    You could even invent a nice self feeding money pot of useless under paid pseudo jobs supplied by privately run leach companies that then supply cheap labour to multinationals, but where do we get a large number of bodies that are so desperate they are willing to work for under minimum wage? Hmm… hmm, any ideas? I see a Tory, Philip Davies floated the idea that by definition disabled people can’t work as hard and so don’t deserve minimum wage. It’s no coincidence all the calculations and venn diagrams have already been done for these companies the only problem is the disabled people decided to appeal on mass.

    There are evil people that do things because they are greedy or evil or both not because they are inept look at Mr Bush he seemed a bit silly didn’t he but he is the one Laughing now with all the money he made he and old wide grin sure made a lot of money spend more than they earn apparently.

    I remember watching the video and had a look again, it’s strange there is only just over a thousand views for that video, but if they released a video of some idiot ripping a fox or Badger apart or a video of Katie Price running around in her swimsuit they go viral, just shows where peoples priorities lie and it’s not with people who are unemployed through no fault of their own because in this I’m all right jack world the poor don’t count.
    And yes there is plenty of money about, in fact there is so much money this Government decided to give £11 Billion of it to Africa but any fool can see it goes straight in to the bank accounts of tinpot dictators and despots. Britain gave money to India not long ago, did the Indians help the poor unfortunates NO the Indian Government took delivery next day of four nuclear submarines from the peoples republic of China.
    So it’s a lie that there is no money left, and Cameron ought to hang his head in shame, better still why doesn’t he just take a half bottle of whisky and a handful of pills and go away and lie down somewhere, because I for one is sick to the back teeth seeing that face of his ( A face you just wouldn’t get tired kicking by the way) every time I turn on the television…!!

    I think the thing that upset me most about this video on JSA sanctions is these are mostly young people with their lives ahead of them, trying hard to work and the people that are meant to be there to help them are just pushing them further under. I mean the young guy featured broke my heart the JCP screwed him over then his parents chucked him out, luckily he had a friend to put him up and as you say only just over a thousand people even bothered to look at it. What is crazy is these JCP/DWP staff that follow these quoters and rules forget one day they will be unemployed or old and they will have to deal with new lot of brain washed zombies that work at the JCP/DWP.

    The Cons started off as they meant to carry on, when they first arrived in office they started rolling up any good changes labour made, closing SureStart Childrens Centres, youth projects etc. you know all those things not really needed by the rich and quite useful and good for the poor.

    I spoke to Osbourne about a different matter once, he’s an idiot, he undertood nothing of the politics or policies I was talking about, even though it is a big news item now. Channel 4 revealed that he’s avoiding paying tax. He pays accountants to help him find loopholes which Channel 4 reckon will help him dodge £1.6million. These kind of “legal tax dodges” cost the rest of us billions. I believe his family also put the family business into trust to save it from being taxed? Don’t get me wrong I have nothing against rich people I just don’t like the ones that are stealing money from the system them standing on my neck saying I am a scrounger.

    I have been all through this appeals thing before in the 90′s I waited more than a year living on £35 a week as I coud not sign on. I was represented at appeal and got the decision reveresed I was so angry after so many months it took about 15 minutes for the appeals panel to say it was wrong. I complained to the mnister in charge of welfare at the time and you know what he said to my MP? “well he got a nice lump sum in his pocket didn’t he” even after I had been vindicated as being wrongly removed from benefits still the intimation was I had somehow won the lottery by getting back the money that was always legally mine. They are all cunts no matter the party, how long did it take for Clegg to bend over? the only thing that they cherish and want is power lets all offer our votes on block to anyone that will listen to us and change the system.

    They will pay at the next election all right, Cameron himself says he doesn’t care if he loses the next election (Andrew Marr show) as long as he is doing the right thing, what a joker eh.
    So that means the BNP, UKIP, GREENS and some left wing parties will gain, god knows what kind of world that will be, a mixture of different parties and independents all babbling idiots and not one of them with a clue.

    I guess having a social conscience dooms us to always think what’s best for everyone. I wish that was more preverlant in parliament.
