I recently received this horror story from a reader, it demonstrates the lengths ATOS will go to to meet their targets and what their alleged Doctors will do to ensure they get paid! I have removed some ( 2 sentences) of the text to protect the sender, otherwise the missive is as it was first written.
Ive been reading and taking advice from your web page and would like to give an overview of my recent medical.
Basic background of my case – diagnosed with breast cancer in mid 08,  lots of surgery late 08 which included lymph node removal.  Chemo and radiotherapy treatment, now hormone tablets and anti depressants.
I had my medical yesterday – what a nightmare. Arrived on time, kept in waiting room for 1 hr 15 mins, very busy! We were last in, I thought they had forgotten me as one guy had been there 3 hrs as they had forgotten to book him in !!
The questions are unreal – she checked all my medication, checked what treatment I had. Asked how I felt about returning to work, asked how I felt. I explained since filling in the form I am now on anti depressants and had a fall due to dizzy spell – this has caused cracked or broken ribs and severe pain and lymphoma in my right shoulder, arm and breast Surgery side. I can hardly lift my arm and live on painkillers at the mo. Also explained I have not even been given the all clear by my Oncologist since finishing rads in April. She then had me moving arms, head, legs, bending, grasping etc a lot of this I could not do due to pain or stiffness. Then the trick questions which I had been warned about!! They ask in a manner of conversation, as if they really are interested – what do you do to keep occupied, any hobbies? of course you cant say yes as they deem you able to move about, bend, use arms etc!! Also did I have a garden?? to check if you are able to bend, lift etc Do I enjoy cooking?? to see if you cope at home – it is a bloody insult but you have to play along with this. Asked how I get up stairs, cope with housework, getting dressed, bathing and washing hair – explained I wear a wig lol you should have seen her face lol.
I am now waiting for result and she said I may be asked to go back – over my dead body!! I finally left the building at 5:45, they locked the doors at 5;30 !! What a nightmare and insult that we have to go through this. I have worked all my life, never claimed sick pay or unemployment, I have the nerve to get cancer and am treated like a fraud!! Hubby had a go at the doctor along the lines of ‘why is it that anyone claiming benefit is treated like idiots or cattle and made to feel like the lowest of the low” ie waiting conditions and treatment by staff.
I am now awaiting the results and will let you all know. If they deem me fit for work I really don’t know how bad you have to be to qualify?? but I can assure you all I will appeal!! Sorry to rant but it makes me sooo angry.
There is one thing that is really bothering me.  I took the advice from your site and asked to read or have read back to me her notes, so I could correct any misinterpretation!  She refused on the grounds that she was not allowed and I can request the report after their decision.  Is this allowed or even legal? Hope you can help me on this.
Sounds typical of ATOS alleged Doctors method of operation. I wonder if your examination can legally continue after closing? might be worth taking legal advicethere. as for hinting that you may have to return for a second visit, does this indicate that the alleged Doctor knew she was breaking the law? or was she more worried that she will not get her fee for your examination? also, is the alleged Doctor admitting that she can not reach a decision after your first visit? if she is entitled to a second opinion, so are you. So I suggest if you are called back you seek legal representation well before going and ask if they (or their nominated representative) are prepared to accompany you. You never know, you might just have a sympathetic lawyer who thinks he or she can win the case.  As for reading their findings back, none of them want to be challenged and will likely as not refuse, they also know you are under extreme pressure and want to get out of there fast, they know that they have the psychological advantage here and use that against you. Its amazing how well planned their operation is and you miss it unless you take along hard look at what they are doing.

  1. i recentlly attended one of these interviews.to put you in the picture i was in a road accident,suffered bad whiplash.the road accident aggravated other injuries i already had.ie 2 fractures in pelvis,2 fractures in right ankle,fracture in left shoulderblade,fracture in right wrist.spondilitus.i also have serious skingrafts and muscle loss in my upper left arm due to severe lacerations and tissue loss.however the atos healthcare professional awarded me 6 points for the entire interview.even though i could not walk without a crutch and have not had full use of my left arm for the last 14 years.the healthcare professional claimed i could put both hands above my head(Even though the muscle loss prohibits this with my left arm)that i carried a bag(even though the bag was tied to the crutch)that i did not bring my medication(even though in the bag was the medication)and i could sit and bend and do a squat and kneel down with no problem(even though im having treatment right at this moment for cartlidge damage,hence the crutch)and that i could walk 60 meters without aid. isnt a crutch an aid?(even though the waitin room at 5 ways b’ham is no longer than 80 feet and the dirty office is opposite the door you come out of.my doctor allowed me to see what they sent.it said that i should not be given a sick note as there is nothing wrong with me.my doctor said these people do not know anything and how on earth can a person like me go to work?the reply the dwp has sent me just about caused me to call them a bunch of fuckin nazis.it is full of inconsistences and has allowed the atos healthcare proffesional to add other things that are nothing to do with me.one question.”can sit stand,bend squat and kneel with no problem”.no points.”can walk unaided for 60 metres” no points.every other single area was awarded 0 points.and i realise that the atos healthcare professional is a lieing bastard.will let you know progress of tribunal.

  2. I recently had my medical by an ATOS practitioner nurse, after being kept waiting for 1.5 hours, the medical itself took all of 15 minutes and most of that was due to his two finger typing. I did complain about the waiting time as i had arrived 20 minutes before my appointment time, only to receive a letterstating they could not provide a reason for the delay due the the Data Protection Act!!! What a cop out!!

    On recipt of the medical questionnaire, which i requested, the responses had been manipulates (the ones i answered) and some of the questions i had not even been asked but the nurse took it upon himself to answer on my behalf.

    Mine is a mental health issue, been diagnosed by a psychatrist but the nurse overuled his decision, making a mockery of the profession of my qualified practitioner.

    I have been advised (unofficially) that 80% of claimants fail their medical but surely if this was carried out correctly then DWP would not have mounting costs dealing with appeals.

    Talk about a dictatorial government!!!

  3. Yet another dissapointed ATOS customer, complain to ATOS, the DWP and the BMA. Its time these fools were told they have neither the right or the necessary skills to overturn a specialists diagnoisis. In fact I dont see how they can overturn any decision as they obviously dont have enough time to get to know the patient in the first instance. Its time this shambles was brought to an end.

  4. I had my ESA stopped few weeks before major surgery and still weeks after the surgery I still was not paid. The Dr at the ATOS put in what she wanted to say rather than what I had said. She left out my conditions or stated in her opinion what they were …mild bladder loss-i had full baldder loss-mild depression-i have had it since i was a teenager and am 45yrs and crying everyday up through the night crying and lots moreIS NOT MILD- more lots of evil stuff- and then knowing I am due surgery to remove certain things and a part of a major organ, she(HCP)ATOS states at the back of my assesment form- a recemendation to return to work within three months????? i did ask if she was a DR? but who knows does anyone ask for idenfication of these people assessing us? I cannot take the word of ATOS after recieving my letter of response from my complaint WHAT A LOAD OF LONG WINDED WORDS AND AVOIDING CERTAIN SERIOUS COMPALINT POINTS OR SMOOTHING AROUND MY POINTS OF COMPLAINTand trying to turn it onto me!!!!!. Untill the goverment is bought to task over these evil people and that would mean a huge march in london to 10 downing street, with the thousands of poor sick people who have been wrongly treated/and their money taken from them by the actions of the ATOS HCP then they will continue.

  5. Thanks for that S, and youre right, the only way to change the system is by people power. As I have said before, the Government reckons that there are 1.6 million claimants of sickness benefits, if this is the case its pretty simple to me, just demonstrate with your vote at the next election by voting for whoever promises to do away with ATOS or supports disabled people. It doesnt matter if you cant walk, talk, hear, or even move, you have the right to vote so use it. I am going to….. Good luck and I hope you appeal.

  6. Hi all, I recently attended the DWP “Medical” by ATOS in Manchester, this I must admit was my first ever after receiving I.S for around 13 months. I underwent an operation in Jan 09 to repair badly damaged tendons in my right arm and shoulder after a serious car accident 12 months ago. I have worked since leaving school 16 years ago, and otherwise was fit and healthy. After the op in Jan, my tendons have been shortened and replaced within the bone, I have severe pain in the right arm and shoulder and find it difficult to maintain “Normal” movement and live off a diet of Morphine, Codeine and other meds. I explained this to the “Medical expert” from ATOS, he did a physical examination (Hold your arms out in front of you, OUCH, Twist them, OUCH), and not to mention the mental side of it, and the addiction to codeine after taking them for 18 months, that was 4 weeks ago, I have just been informed by the DWP by chance on a telephone convo that i did not score enough points, LOL. I have yet to receive the full report (Due anytime now) on how, why, what, when’s. I have already drafted my appeal letter. My Question is: Can I use an Expert Medical Witness (Namely an Orthopaedic Surgeon) exerts from a report I have obtained for litigation purposes to defend the decision?. This clearly states my injuries, and recovery time and a future prognosis.

  7. Hi M, No surprises there then eh? It’s an awful thing to say but you must have to be near death to fail a DWP medical…….When you get your Tribunal date contact the local CAB or your local Authority for assistance with your appeal. They can give you much better and legally correct advice than I can. All I can say is I took every piece of relevant supporting information with me to my Tribunal, I did not need it, but I am sure it would have been invaluable if I found I was in a complex question and answer situation. Tribunals are only interested in factual information and will not accept heresay or unsubstantiated claims. So if you can provide expert opinons relating directly to you I would do so. Good luck, keep us in the picture and how about a description of the “medical” centre you went to, i.e. parking, how far from ther to the office, seating, spy cameras etc. It can only help, dont give any names or dates though, dont want you getting into trouble!!!!

  8. I recieved my “Personal Capability Assessment” form through the post today, what a shock? I actually scored 0 points out of a possible 15. The section which was mostly directed at me (as I have a Shoulder/Arm disability) included lifting, carrying, and other task’s which arms are required for, and for which I have the most trouble with, I scored A BIG FAT 0, this is despite me telling the “So called Doctor” I have trouble lifting a small pan of liquid. Now what I have done today is spoken to my solicitor who is dealing with my compensation claim for my injuries after the car accident, and he has advised me to request the full report from the ATOS medical (Which is being sent today), he also instructed me to request a copy of the Medical Examiners “QUALIFICATIONS”, this does not breach any confidentialality laws, nor does it effect either data protection acts, my IB 50 form mentioned a problem in a specific area, in my case Upper Limb(s), the dwp advisor said this was the first time this has been requested, but it is legal and can be scrutinised or used in a tribunal case. (DING DONG)
    The ATOS office I attended was the Bridge st in Manchester, and as described on this website, is 100% as that person described. I will post again soon to update what happens.

I left work in May 2009 as I was suffering badly from an ongoing depression ( I have suffered with it as long as I can remember and regularly take medication) I also have alcohol dependence and Anxiety problems, I had my medical about 2 weeks ago, The doctor could hardly speak english and asked stupid questions such as what program do i like to watch on television!!! It was appalling and my friend could not believe that the doctor asked me such personal questions when he didnt know me. I then recieved the report and found i only got 6 points out of 15 as ‘ I could keep to a daily routine even though I over react to minor events and criticism’ I was shocked and upset at this, there was no mention of the fact i sometimes drink over 40 units of alcohol a week, i have difficulty sleeping, i am sometimes so tired i sleep all day, he also said i had no problems going to familiar places even tho my heart rate hits about 120 bpm when i go outside!! I dont know what else to do but have been told to appeal.

  10. Thanks for that P, I think I would appeal on principle too. These alleged “Doctors” tend to ignore the obvious and focus on the things they can percieve you can do, rather then what your illness/disability prevents you from doing. Call your local jobcentre, ask for a copy of the report, read it carefully over a few days so your appeal is not a knee jerk reaction to it and then write your appeal. If you cant mnage this get someone you trust to help you or do it for you. Seek assistance from your loacl authority or the CAB. I wonder if they are following a strict administration process to “standardise” the “examination” and treat each case ” equally” how and why they can ask suplimentary questions (questions which do not appear in thier report at all or are not on the official administrative list of questions) so fluidly and yet are bound to select an answer from a drop down list to complete the form? We seem to have no chance…… time for a change I think.

  11. Any chance of everyone writing to the PM about all this, I hope GBrown does not get sick but then he will be covered unlike his poor sick people he is supposed to be looking out for.
    I have been made more ill since being put on ESA, with my children and them EVILS stopping my money few weeks before my sugery and weeks after it too, put me and the children into poverty- did the PM not set a policy to get children out of poverty? done the opposite to me.
    My children were worried sick about my surgery and i was worried sick about the money and running the home and would i survive the op.
    EVIL that is all i can say about ATOS and DWP they nearly pushed me over the edge and still on it.

  13. Had a DWP medical over 2 months ago and failed. I got 10 points. I have COPD and on the day of the medical I was extremely ill. COPD means I struggle to breathe.
    My Incapacity Benefit was stopped just over a week after the medical and I have just received a copy of the medical report as I have appealed. I sent a letter from my Doctor with the appeal and a letter detailing the incosistencies with the points awarded and the information I have actually given.
    I have skimmed the medical report and had to put it down as I was getting more angry by the minute. I really do not know why they need us to go along to these so called medicals as they obviously put whatever answer they decide on without taking any notice of what is being said.
    Apparently my condition will improve within 6 months, COPD can only be controlled, there is no cure.
    As I said before I was having a particularly bad day on the day of the medical and was coughing a lot while I was trying to answer the questions being fired at me. The Doctor has stated that I coughed throughout the medical but stopped as soon as I left the room.How would he know what was happening when I left the room as he did not leave with me.
    He did not mention that I was reduced to tears or that I repeatedly told him that I was having difficulty coping because I felt so ill.
    I have spoken to Welfare Rights who will be representing me at my tribunal and was advised not to take things personally when I read the medical report. I was even told by a member of the job centre staff that the system was unfair and that the medicals were a farce.
    I cannot claim income support because my husband works and am not eligible to claim job seekers benefit as it is means tested but I would be uneasy claiming anyway because it is surely fraud to claim you are fit to work when you are not.
    I have spoken to several people who have given up and are not appealing because thay cannot cope with the stress and I understand totally why but I am determined to fight back.
    I would like someone to explain to me how being able to stand on one leg means I am fit to work a 40 hour week or am I just being dim!!!!!!!!
    I will be writing to my MP and asking for a written reply.
    My mam used to be a civil servant and she often talked about MP cases having to be given prority so maybe if MPs are inundated with complaints someone might eventually listen.

  14. Excellent, please appeal, the more we highlight thier mistakes the more difficult it will become for them to be taken seriously. I think this sort of decision is dangerous and has an obviously disasterous effect on the lives of benefit claimants. As for inconsistancies, well, dont get me going there, I was given points which amounted to a begrudged single figure, at my appeal some months later this figure was increased tenfold, yes, magnified by ten. A huge victory and a slap in the face for the fool who allegedly “examined” me. Dont give up hope, go through your report one item at a time, mark those you see as downright lies first, then do assumptions then anything remaining. Take your time, ensure you challenge everything you need to (I had loads of items) and be precise, for example, provide any evidence you can confirming your condition, do as I do and keep a diary of your visits to hospital or your GP, provide a list of the medication and the amounts you take daily. Where the alleged “Doctor” has made an assumption or lied say you do not know how the “Doctor” arrived at this conclusion when your answer was completely different, dont call him a liar (This lowers your own standards) simply cast doubt upon his perception of the severity of your condition. Contact your M.P. and again keep a record of this, set a deadline for a reply and demand you are dealt with as an individual, refuse to accept a standard letter as a reply, question any obviously bland or grey answer. If you dont recieve a reply make sure you have a reminder ready to send on the day of your deadline. Remember, our M.P.’s allowed this to happen, they also need to know we are unhappy with the job they are doing and that this will be reflected at the next local or general election. Hit these fools in the pocket and they will jump, mark my words. Please let us know how you get on and a description of your local medical centre would be useful. Bear in mind when posting descriptoions of medical centres distance form parkingease of access etc I protect the anonimity of the sender.

  15. Thank you for your advice. Have just started to go through the medical report and highlight inconsistencies. Trying very hard to stay detached and not take it too personally.
    My medical was at Vinovium House Bishop Auckland County Durham. When I phoned to make the appointment I asked about parking as I knew that there is no public car park for the building. I parked in a shop car park which is about 200 metres from the building . There are 3/4 steps up to the building and a ramp. The doorman told me which floor to go to and the lift is just inside the entrance. I was extremely out of breath and coughing a lot when I went in. The receptionist was abrupt and when I apologised because I was coughing when I was trying to answer her questions she told me she had a bad cough as well!!! I was told in appointment letter to be there 10 minutes early. I waited for about 25 minutes for my appointment. Did look as I had been told there were cameras in waiting rooms but did not really know what to look for. The receptionist was not sat at the reception desk but at the back of the office. The person conducting my medical came out and called my name and walked me to the room. He repositioned my chair very carefully before I sat down and after had asked me to stand up to do “examination” very carefully moved the chair again. Big mistake I made was not taking someone with me as I have no witness to what was said. Receptionist sat in room while he did exam which I assume is standard practice. She was slouched in a chair straight in front of me with her cardigan wrapped round her staring at me. I have spent years employing and training staff and her manner was totally unprofessional. Was asked to leave the room with the receptionist who did an eye test in the corridor and then the Dr came out and asked me to go back to ther exam room as he had forgotten to ask some questions. As all the questions are on a computer how could he have forgotten to ask. Can only assume this was to watch me walk around. By this time I was totally exhausted. Best bit has to be when he finally said I could go he actually said he was sorry I was so ill and was glad I was getting treatment.

  16. Thanks for that C, First, remember, do not take this personally, they are doing this to everyone they see. Next did they ask you if the receptionost could be present during your “examination”? I would never allow that to happen, as far as I am concerned the “examination” is private and should be attended only by others by prearrangement. Do you know you can ask to be seen by a “Doctor” of the same gender? this prevents them having biased witnesses present at your examination and will eliminate those feelings of intimidation you had, if they have not offered this facility, raise the matter and challenge it. Make sure you ask for an adjustable chair, without wheels, ask for a Dr of the samer gender, ask them to remove the steps they have you climb to get onto the examination table as they are unnecessary and you know examination tables can be adjusted to suite the individual. No self respecting NHS Dr would ask a patient to climb 2 steps onto an examination table. If they trot out the excuse that the table is broken tell them it is unsafe and refuse to climb onto a piece of damaged equipment, this practice could be potentially dangerous especially if your balance or co-ordination is poor or you suffer vertigo. Make your requests in writing and staple it to your IB50 (top and bottom of the page so they cant say it got lost), by doing this you guarantee reciept and it makes it difficult for them to ignore your requests as they will want to ring you as soon as possible to get you in. Next time you go take someoone with you to make notes, they hate that especially if you ask about thier qualifications before the “examination” The DWP know you will be expecting the worst, and will panic so take your time, if you become frustrated whilst checking the report stop! and come back to it later, you will get ther in the end. Never attend another “examination” alone, I’m not. This is the first time I have heard of an eye test being performed let alone by a receptionist of all people, what gives them the right to do that, surely eye tests should be carried out by qualified opticians? how on earth would the average receptionist be able to interprate the results? That in itself is questionable. Also had the alleged “Doctor” informed you the “examination” was complete before calling you back in for further questions. if so I would challenge any comments he made during that time. Contact your local authority welfare rights team and seek thier assistance, I have found my welfare rights team really helpful. Remember ATOS are on the ropes, they can not get qualified real doctors to work for them and are training unqualified people to carry out “examinations” ask if the person you are dealing with is a qualified doctor, it comes in useful during any appeal you may have to go through as real Doctors are appalled by this practice.   17. Hi again, please feel free to add my description to the medical page.
    I was told he was going to get the receptionist. I was not asked permission. I was never offered a Dr of the same sex. I was not examined on a table. I was asked to stand up, bend over, stand on one leg and then sit back on the chair while he listened to my chest. I refused to do a peak flow test because I was coughing so much.
    I had made a mistake on my IB50 form when I filled in the part about the eye test which I pointed out to the Dr. (I am assuming he was qualified as he was using DR. as his title). He said that lots of people made the same mistake. Am assuming this is why I had the test but I was a bit confused as to why a receptionist did the test. I honestly cannot remember whether he told me the examination was over before I had to have the eye test but he must have turned the computer off because he called me back in telling me he had forgotten to ask a couple of questions and he scribbled notes on a piece of paper.
    I have just got paperwork from the tribunal today I can expect the case to be heard in APRIL.
    I have spoken to welfare rights and filled in the paperwork for them to represent me.
    I will never attend another examination without someone with me again.

  18. Well done C and thanks for supporting us by telling us your story. It sounds like you have been through hell with these idiots, make sure your representative knows every detail you can remember. Carry a scrap of paper and pen with you in case you remember anything you have previously forgotten about and write it down. The more information you can give to those assisting you including the Tribunal the better. Also be sure to tell the tribunal you were not offered the option of being examined by a “Doctor” of the same gender and the unprofessional way in which you entire “examination” was carried out. A receptionist!!!!!! indeed? Keep us informed, remember, the more first hand information we have, the better off we will be. The DWP hate blogs and web sites like this one as they highlight the inappropriate, inaccurate, irrisponsible, illegal and downright underhanded way in which they operate. The stress caused by the cessation of benefit payments to lone claimants and those who have families is cruel and uncalled for, this should not be allowed to continue. Spread the word about this and the other sites listed here, also ask your friends and relatives to think carefully where they put thier x at the next election, remember both the major parties want our heads, lets take thiers?

Thoroughly disgusting what I have read above I have asked for assessment at home as have post traumatic stress, depression, panick attacks and vertigo also a serious head injury with balance problems and hearing loss they told me to send in letter from GP to be seen at home, I did, and recieved date to attend an office, I been trying to ring now for 2 days every hour, get the automated voice and music cant get through to anyone to sort out this appt. We should all write to parliament we need someone to write this to,

The same company Atos decide on DLA so now i realise why my youngest son who is autistic was after 11yrs taken from higher rate dla to lower rate, they said he was streetwise and only needed one hrs care a day and to stop his sleepwalking out on to the street to put extra locks on door this is a child who is totally distressed it his mother isnt around and by the way i have waited 5 mths for appeal date i think they should spy around the pubs clubs bingo halls and betting shops for the ones they should be taking off benefits not genuine cases what happened to human rights

Yeaterday i recieved a letter saying that i did not qualify for esa ??? i am having open heart surgery in two weeks time. these medical officers pushed me in the room asked what they deemed relevant and as quick as i entered i was exited. I have a condition that effects less than 1% of the population. I do not think the tick sheet asked whether i could swallow properly one of my syptoms of my congenital abnormality. the assesor said that my problem of feeling faint and having numbness of my arm when elevated could be resolved by not elevating it. ok i will start a job and when they ask me to lift something i have to refuse incase i pass out. who would employ me. ********* idiots, she might aswell as told me not to eat as this causes pain. they are a bunch of looneys i could do a better job by actually finding out the actual cause and not basing it on weather i can fully wipe my own back side. next time for us people who are genuinly in need of esa crawl in the office and say we need to burden the country with our need for 24 hour care based support. say everything hurts. they like ticking boxes i think. it has cause more stress on me now. no money for the kids when i go in hospital boucing bills etc. the esa are the cause of most peoples onset of depression.

I think they are at thier worst when you dont fit the ticky boxes? the trouble is they are limited to a choice of 4 or 5 possible answers, this can not possibly work in the reral world and thus most peole who come into contact with ATOS find thier benefits suspended. The problem is that the information you give them is misinterprated by the cardboard cutout and twisted to meet the needs of thier academic process rather than reflecting the patients true state of health. Vote with your feet at the next election and help to keep both the present Government and the Tories out of No 10, its the only way we have of telling them they are wrong.

I think the political debates on TV have given the game away, ATOS is a government puppet, when the government want unemployment down stick everyone on ESA when they want ESA claimants down (help 1 million disabled & sick back to work) they get ATOS, who will be only too willing to obey their paymaster, to alter the assessment so you have no chance of getting ESA. The HCP normally has no idea about the illness you have, I think in 2008 at my assessment the HCP asked me what my illness was and immediately turned to the PC screen, possibly because she had no idea what it was. If asked what my conditions are this time I may after telling the HCP ask and if the HCP skips straight to the next question, I will say you haven’t answered my question and as I will have at least 1 person with me or 2 if they are not called in to work.

    ANGRY I feel sorry for you as 1 of my illnesses that is present from birth and quite often doesn’t show itself until your mid to late 20′s and in some cases is only found after death at an autopsy. Any rare illness that affects people in different ways from not at all to very severe the HCP will choose to say that the condition hardly affects you.
    I sometimes wonder if a coroner wheeled in a corpse that the HCP would write a report so the decision maker would find it fit for work even if the coroner slapped a death certificate on the table.

  27. ATOS have got it wrong, of that there is little doubt. They are clearly working to achieve a Government target so they can reap the profit from thier actions. It would not be so bad if they actually carried out an assessment which considered the level of disability most claimants have. It is likely that it would be in thier own interest to do it this way as there would be less complaints, lower numbers going to appeal then to Tribunal and so on. The issue is that ATOS is populated by retired has beens, “Doctors” who have had thier authority to practice remoced and the dregs of the medical profession who have jumped before they were pushed. The vast majority of thier so called “Doctors” are arrogant, ignorant fools who are simply in it for money or revenge, what more do I need to say.

The system is heavily weighted against the claimant, wheelchair users could be declared fit for work because they can answer a telephone, so can work in a call centre cold calling people at all hours of the day or night. Atos the DWP and tribunal staff (include the government in that, they are the head honcho) would and will say people are fit for work at any and every opportunity, it makes me wonder when the government will make prostitution legal so those confined to a bed with say M E will be declared fit for work because they can prostitute themselves, that way they get some more people off ESA onto JSA. Why do claimants have to apply to the DWP for a copy of the work of fiction, if the report is done while the claimant is there then why don’t ATOS just print a copy off for the claimant to take away with them if they want to? Maybe because the report the claimant receives is actually completed long after the claimant has left the building and maybe at home by the Gestapo agent, I mean HCP. My opinion on why they do not give you a copy while there is that someone who says they have a mental illness may attack the Gestapo agent if they were given the report and it contained lies, by making claimants apply to the DWP then by the time you get the report they hope you will have forgotten your replies or lost the written info you took at the interrogation.

  29. I suppose the real reason is a little more sinister! I believe that “examinations” are recorded and these recordings used later by the HCP to derive thier report safe in the knowledge you are out of the building. This is hinted at by the fact that the HCP will not go through the report at the end of the “examination” to check for inconsistancies, the main reason is, they dont exist at that time and have to be made up later, when you are gone. I too worry about the impact of the new work capability assessment and how that will affect people who are currently on benefits. Maybe there is scope for an argument in law, afterall, if someone is judged to be unfit for work by the Government in 2010, then in 2012, with the same disability they are declared fit! Maybe the decision can be overturned as it would appear that the Government lap dogs at ATOS are contradicting thier original prognosis and by doing so may well endanger the lives of disabled people by forcing them, prematurely back into work whilst still unfit under the previous PCA.

That is one thing I wouldn’t put past them, as in my 2008 assessment it looked to me like the assessor was just hitting any old key and she was very keen to keep my sight of the keyboard obscured, plus she hit the keys with the speed of a touch typist, how many medically qualified people have the skills to touch type at a very fast pace? None that I know of, so your opinion that ATOS either record the audio or use video with sound is probably correct, I would go with video recording as they will be looking for anything they can to get a fit for work diagnosis. The WCA I cannot wait for just let them put a pen or pencil on the floor and ask me to pick it up, they will be told in no uncertain terms where to go, I wouldn’t be surprised if you told them that it caused you severe pain to do it so won’t do it they write refused to do whatever they asked you to do. I believe there maybe something in the human rights laws about it maybe ARTICLE 3 THE PROHIBITION OF TORTURE?

    After all even asking you to do something that will cause you pain, I don’t know how to put this, they ask you to do something , you know it causes you severe pain and want to refuse telling them it will cause severe pain, but do what is asked putting up with the pain and it clearly shows on your face and because you put up with the pain they write can pick up a pen/pencil from floor. So ATOS torture claimants by making them feel or think that refusing to do what they are been asked to do will get the ESA stopped. IMO I think many who falsely claim disability benefits do so by saying that it causes them severe pain to do what is been asked of them. Are those conducting the WCA taught to scare claimants into doing, or trying to do, things that causes them severe pain IN MY OPINION I THINK THEY ARE.

  32. i went to one of these medical exams 4 months ago at five ways in b,ham. it was the third time that i had been called in in 9 years.i have depression and spinal injuries which make it hard to walk and move about most of the time.the dr asked all sorts of questons about my history.i dont no what happened in there but after asking me a list of questons for about half a hour,he looked at me and said why r u here i can c that u are in pain and that u havent understood half the questons that i have asked u at all.he went on to say that i was in a world of my own and that i made him feel uneasy.because i kept stairing at him all the time.2 weeks later i got a pass of 15 points.all i did was tell the truth about myself.

What needed to be added to the report after the person had left that took nearly 15 minutes to complete?

  35. Remember after submitting your ESA50 form you can and should ask for the medical justification in writing that a face to face assessment is necessary. Point out that you may want to ask the GMC to review the medical justification. The contract between the DWP and Atos is clear in respect of medical conditions that mean a face to face assessment is not necessary. An Atos appointment clerk will hound you. Be polite and just email Atos asking for the name of the medical advisor and the medical justification. Avoid the phone use email. You have a full record of your correspondence.

    Even if a face to face assessment is deemed necessary there are certain medical conditions listed in the contract for which the assessment must be carried out by a specialist in the particular medical condition or the medical advisor MUST contact your GP and or Consultant. If travel to the assessment centre is adding to your stress point this out in an email and insist on a domicillary visit (Atos will visit you at home). When they arrive check they have specialist knowledge in your medical condition. I have heard of a number of instances where the health care professional has backed off at this point because if carried out the assessment this would constitute an assult. You report them to the GMC and they would be in danger of being struck off. After the assessment make sure you get a copy and that it was carried out by a “qualified” as defined by the contract.

I know you are ill and there is a lot there maybe a friend or carer or citizens advice can use the information here. I do not know why the DWP does not enforce the contract withe Atos.

    I just received another 100 GBP for Atos the first part of the compensation I am expecting from them for being in breach of the contract between the DWP and Atos. When you have sufficient evidence this may be a NAO or Police matter. Is there undue influence between Atos and certain individuals in the DWP?

  36. I forgot to say that if you are denied an allowance, the stress of this can make your medical condition get worse. Ask for a reassessment? If like me you can’t write anymore the DWP will complete your ESA50 for you and send you a copy for you to approve. Remember they do not have access to your medical history and they are believed to be rewarded when they reduce the allowances that are paid out. Insist that the allowance is paid while investigations or reassessment is ongoing.

I have medical assessment nxt week and after reading all the comments and experiences on this blog has freaked me out….I am not looking forward to it at all.I had worked for the past 36 years up until 3 years ago when I was made redundant through no fault of mine, my life has been rock bottom since.I was claiming JSA up until few months ago as the jobcentre made my life unbearable ( made me feel like a scrounger ) having contributed all my life to give me benefit that I had paid into unlike some. I became very ill with depression, suffer with anxiety too, any jobs I applied for were rejected due to my age I also suffer with IBS which effects my everyday life. Since been on ESA all I have had is more worries and stress and now the medical examination.Worry causes my IBS to be worse I just wish someone at DWP would assess claimant on their work history too and not tarr genuine people with the same brush as people who are cheating the benefit system.

  38. Welcome to our rapidly growing community of ATOS victims, If you take a look at the other pages on the blog you will see you are not alone, this is the most important thing to remember. Atos and the DWP are not attacking you, though that’s whet they want you to think, they tar everyone with the same brush. Take someone with you, someone you can trust. Ask them to take notes of the proceedings, the ATOS cardboard cut out will not like it and will try to put you off by saying you cant use your notes at any tribunal or in any court. Don’t worry, just carry on regardless, its your right to take notes, take a close look at the alleged “Doctor” though, those little tell tale beads of sweat on his upper lip and his figiting will conform you have hit a major nerve. They hate it when you have a witness who is taking notes. To make your life a little easier I have produced an assessment form on the assessing ATOS page, this form will allow your companion to score the building, “Doctor” receptionist, parking etc and will serve as an aid to your memory when you are writing out your appeal. The DWP usually wait a month or so before they stop your benefits and the letter usually arrives the day before or on the day your benefits are due, for maximum impact. This is a terror tactic they use, they know that the majority of benefit claimants rely on their payments being in the bank or on their doorstep on time, they also know that the worry of not being able to pay rent, council tax and to buy food is a great motivator to get you to reclaim on jobseekers allowance. On the assessing ATOS page you will also find a useful contact form, print some of these off and keep them near the phone. It is essential that you gather the information the form asks you to and that you make a written record of your conversation, it helps throw them if you tell them you will be making a record of the conversation, they hate that. No doubt you are aware of the help available from your Local Authority Welfare Rights Office and the C.A.B. It is essential that you seek assistance from one or the other and particularly as a representative at your tribunal. ATOS and the DWP see themselves as judge, jury and executioner untill you take the upper hand. Fight them all the way, when you are at your tribunal come across as a credible witness, don’t shout, swear or act aggressively toward them, they are in a position to help you.   40. Try to remain calm, print off the assessment form on the assessing ATOS page of this blog, get your friend to make notes about your visit. They will tell you your notes will not be accepted as evidence in court or at a tribunal, tell them thats fine and continue. From now on make notes of any conversations you have with ATOS or the DWP, there is also a contact form on the assessing ATOS page, print a few off and keep them by the phone. Remember its your right to make notes. Call your local JC+ tomorrowe and demand a copy of your report, you are also entitled to a copy, they will try to put you off, be polite but firm and ask to speak to someone who can help you.   41. What a nightmare!!! I got there 10 mins before my appointment,Rang the bell to be let in by a recorded msg, had to go up the stairs, it felt very eerie, cold and unwelcoming.
    At the reception there was a man who seemed pleasant enough, so I said I had appt, asked me to fill in a form with my details and asked for my ID….I had taken 3 as suggested in the letter as I didn’t want to carry my passport to unknown area.I took one out and that’s all he asked for and told me to take a seat, the waiting area was big and empty by this stag my nervous were really bad.After about 15 mins the receptionist said the practioner has my file and will be seen shortly.
    About 20 mins later a young girl called me, I said this is my friend so she said to my friend if she would like to wait in the waiting room to which I said I rather she came in with me, the look on her face said it all that she wasn’t happy.She introduced herself as a qualified physiotherapist….my thoughts were maybe she was assessing me on my physical incapability due to back and knees problems and than will see a dr about my severe IBS and depression, but she did it all in half hour typing eveything I said and few bending movements as an examination.
    I was upset talking about my IBS and depression and she even gave me a tissue and said she understood how I felt.I told her I have councilling appointment and offered to show her the letter to which she said she don’t need to see it, as she believes me obviously not doing her job properly.I am on anti-depressant which I took she just had a quick look at them and other medication I am on for severe IBS attack.
    After the few mins examination was told that’s it, She said she was going to e-mail DWP what I have said and they will decide, I asked her if I can have a copy of the report to which she said I have to ask my Jobcentre.
    Yesterday (2/11/10) received ESA65 saying my score out of 15 was 0 and I am no longer entiled to ESA no other letter to as and when or how to appeal.
    The boxes ticked on how they arrived at the decision was
    The questionnaire I filled recently and the reportof my medical assessment.
    Medical information from my GP not ticked so I assume they did not contact my GP.
    I am seeing my GP in a while to find out if they had contacted him.
    How can a physiotherapist assess someone with depression and IBS??
    I am going to appeal as I still have 2 more weeks on the medical certificate and am having councilling through my GP….how do I go about it any help would be appreciated.
    I am so stressed.

I have had sever deppression for years i wached my dad beat my mum she turnd to alcohal then left my dad and got into drugs i am menely scard by the things i have seen. if the dwp would just leve me alone and let me get better but thay dont with the constent forms and interviews and sick lines.
    with the stress of my medical comeing up i forgot to get a sick line now i have no money for food gas ect i dont know how much more i can take

  45. Welcome to our growing community, first thing to remember is that you are not alone. From what you say you have your medical report, contact your local Jobcentreplus and ask for a GL24 appeal form, also tell them you want to claim the assessment rate as you are appealing thier decision. Please note, you must follow JC+ procedures, you will not be allowed to short circuit thier academic system and will have to jump through the hoops. While you are waiting for this to arrive go through your report with a fine tooth comb, identify any inconsistencies, assumptions, fabrications and lies, mark them and once you have completed that task, check it again. You must word your challenge carefully and use the terminology they have in thier descriptors. Challenge each of the comments you have identified individually and say why you think the HCP is mistaken in thier opinion. Anything you challenge should ideally be backed up by evidence from your GP, Specialist, Physiotherapist, Psychiatrist etc. Make your appeal directly to the Decision Maker. When the Decision Maker replies then you must decide on what action to take, if all is well and he finds for you then your Benefits will be restored. If he doesnt, then you need help. Contact your Local Authority Welfare Rights Officer or the CAB, you must decide which you will work with as they can not work together, they will guide you through the appeal maze and support you along the way. Be aware, the process is long and drawn out. I still haven’t rec’d official letter from DWP on when my ESA has stopped from or if I am entitled to appealand the procedure (only form ESA65), I saw my GP after receiving this form, they had not had any contact from DWP or ATOS regarding my health issues prior to my medical assessment and ATOS have made the decision based on half hour assessment without a dr’s ( only a physiotherapist).The only notification my GP has rec’d was to say I was fit for work.I still have 2 weeks sick note and have 6 other councelling appointments so really confused now on how am I suppose to live without any benefits and cannot go on JSA,Haven’t started the appeal process,what can I do until the appeal process is going through for money.I have to write for the medical assessment report as well….so stressed out as all this is not helping my health.

  48. Try ringing your local jobcentreplus and demanding a copy, be polite but firm and be prepared to be put off. This is standard practice, just stay with it, be polite and ask to be ut through to someone who can provide a copy of your report. Remember its your right to have access to it. Whilst you are on the phone ask them what you are expected to claim if you can not claim the “assessment” rate.

  49. I still haven’t rec’d a letter from them as stated on ESA65 form which was dated 2/11/10 about the decision or appeal procedure.
    I went to my local advice centre,they have written a letter requesting medical assessment report and that I wish to appealing agaist their decision.I have been advised to get a letter from my GP, and councillor to back up my appeal and go back to them where they will help me with filling in the form GL24 i think…..so stressed out today, have one month to send my appeal, so have to try an get appointment again to see my GP.

I have just read the papers ( Wagner who is on Xfactor is on Incapacity Benefit getting £97.40 despite informing DWP still getting it ) I am absolutly fuming that DWP and ATOS put genuine ppl who are on incapacity benefit hard time and stop their benefits immediatly after the ATOS assessment.How comes he hasn’t been to one of those assessments, don’t blame him but the benefit system.I am appealing and going through stress and worry on top of my illness, of how I am going to survive in the mean time as the only amount I was getting of £65.45 nothing else at all after working for 36 years of my life and paid my taxes and NI contributions have been stopped……where is the justice for ppl like us? very unfair.

I managed to send off my appeal last week tue 23/11 after waiting for 2 weeks for my medical assessment report from DWP as I had only few days left for the appeal,since than I have rec’d the report what can I do now although I have mentioned all the points which were overlooked on the ESA65 score points (5 pages), dr’s report,medical note,counsellers report, copies of ESA 50 for etc.

  53. I have two broken legs. I have had a rod put in one and screws in the other. I am fit for work apparently!….. I am a builder by trade, how can they think i will be able to work like this? In my medical they gave me 6 points, this was given because i can only stand/walk for less than 30 mins before i need to rest. In my medical report it says i can walk over 200 meters unaided?! How? I was in a wheel chair for three weeks and can just about walk using crutches now, but not very far before i need to stop from the pain. I have no source of income and they have just stopped my ESA outright, no warning, no valid reasons. Even the doctors have given me a sick note for at least another month and have said I cant work. Dont get me wrong I WANT to work, ive been a hard worker all my life but this is ridiculous! How can they say that i am able to earn a living when i would be laughed off a building site if i tried to go back to work??! So angry, the system seems to be aimed at helping people not willing to work not those who want to but physically cant.

  54. Welcome to our world anon, this is why this blog and ur sister forum at ://www.dwexamination.myfreeforum.org exists. The general public are being fed misleading information about the disabled, we are labeled as being welfare benefit scroungers and other derogatory terms by the press, who in turn are fed the information by the Government. Unless you have been in the system, you dont understand what it is like and how difficuklt it is to get Benefits whilst you are too sick to work. I suggest you take a look at our forul for information on the appeals process, you must appeal or ATOS gain credence and declare you a scrounger. There is a wealth of information here and on the forum. Dont give in, its a long drawn out process but dont stress yourself too much if you can. You will find everyone here is in a similar situation to yourself and more than willing to help you with your appeal.

I was an Australian disabled pensioner prior to returning to the UK permenantly in nov 2008. in feb 2009 i applide for and was granted ESA at the assessment rate abt mid 2009, this was cut off numerous times by various DWP personel ( i have some lovely fiction written abt me on official letters) and finally by ATOS. I suffer from chronic back pain, IBS a hiatus hernia and am totally deaf all caused by work related accidents during my 35 yr working life. i appealed and was granted the 15 points needed with the help of CAB on the basis of my hearing problem alone, i did query the tribunal abt why no points for my other injuries and was told 15 is what you need and 15 is what we gave. On the 2 oct DWP again cut my benifit citing late return of a self assesment which is incorrect and there is only their word but they did put me back on at the reduced rate. Atos then carried out another medical assesment late oct and yesterday (4/01/2011) i received a letter that i no longer qualify as i only have 9 points on the basis of my hearing problem. so it seems Altos can overide any tribunal findings even though they know you have the points awarded legally and yes i showed the so called doctor as i did try to show him my swollen leg caused by agrivation of my back by travelling to the examination. none of which was taken any notice of. Atos are a proffesional NO orginisation and the DWP are struggling to keep up with the appeals generated and this is exactly what they want so you give up, unfortunately for most of us theres only one thing to give up isnt there

  58. After I read post #55 I became livid due to the A’TOSsers apparent sour grapes ‘war of attrition’ being utilised in their ongoing persecution of the ill and disabled i.e.

    “in feb 2009 i applide for and was granted ESA at the assessment rate abt mid 2009,…”
    “i appealed and was granted the 15 points needed with the help of CAB on the basis of my hearing problem alone,…”
    “Atos then carried out another medical assesment late oct and yesterday (4/01/2011) i received a letter that i no longer qualify as i only have 9 points on the basis of my hearing problem. so it seems Altos can overide any tribunal findings even though they know you have the points awarded legally and yes i showed the so called doctor…”

    I’d heard about the imaginary wheelchair which the “HCP” can visualise to assess whether someone can “mobilise” for 50 metres, could they be also imagining hearing aids and cochlear implants as well now! If this be the case then where will it end, imaginary Hawkins-mobiles for paraplegics to use to go and sign on for their JSA?

    RE my appeal I had a letter from DWP Attached to it was (Secretary of state’s response 12 pages) agreeing with ATOS and given 0 point and copies of all my appeal paperwork I had forwarded to them.
    I am totally confused to what happens now…..the letter says they have sent a copy of the information and my appeal letter to the Tribunal Service, they will get in touch with me to explain what happens next with my appeal.My medical certificare runs out on the 21/2/11, my GP has given me another one do I forward it to DWP as not sure what happens now……will try and get some advice fron the local advice centre but there times are so limited due to cut backs so cannot always get to see anyone.

The Tribunals service will contact you, you will be asked if you can take a short notice appointment, dont as this may prevent your case being supported by your welfare rights officer (ring your local council office, they will put you through or provide a contact no)who may not be able to attend at short notice. if you havnt engaged a wro please do so immediately, they will assist you with the process and support you on the day providing they have a rep free. Next call your local JC+ and ask to be put on the assessment rate whilst you are in the appeals process. It is highy unlikely you will get any money if you dont. You need to act quickly now, do this on Monday, do not wait.   65. I have been referred by my local advice centre to Law centre and someone is going to get in touch with me I guess ( WRO )If someone is available to accompany me they would do so. I am not looking forward to Tribunal on my own as I suffer from anxiety which triggers off my IBS and am already worried about it on what to expect, I have been told that I can opt out and let them decide with my case history due to my anxiety and IBS so will have to decide.Also Tribunal will be sending me a questionnaire to fill which has to be returned within 14 days on which I can say if I can attend.Just have to wait and see……will keep you posted, Its so awful that genuine ppl have to go through to get benefit that they are entitled to and have payed into all their life,when unable to work due to no fault of theirs, I have worked all my life (36 years) until last few years ago due to redundancy which has caused me the worry, stress ans anxiety of trying to survive, as there are no jobs lot of employers are ageist and lot of ppl unemployed.

  67. Re update on my tribunal hearing no 65.
    I was referred to by my local advice centre to law centre (WRO) they have sent my GP a questionnair asking about my medical condition pending on the report they would decide whether they could represent me or not.In the meantime my GP has told them there would be a charge of £70.50 to complete which I would have to pay as law centre has not got any funds to cover the cost.
    Can this be right? I get £65.45 a week ESA only whilst I am appealing, where is the justice in this?……without his report I won’t have a case, it seems like I will be giving him my weeks ESA+£5.Can anyone advice me on what to do? I have left a note for my GP as won’t be able to get an appointment for few weeks.
    To me rich are getting richer ( dr’s earn a good salary ) and poorer gets poorer like myself when being ill and struggling to survive.

    Sadly, this kind of work (e.g. writing a letter or answering a questionnaire) falls outside of the Doctors’ NHS remuneration, therefore it’s considered as being chargeable “private work” when a patient requests their Dr to do it.
    Sometimes the charges problem can be circumvented e.g. an alcoholic friend wanting their HB to be paid direct to the landlord was asked by the council to get a Doctor’s letter as supporting evidence. I wrote back to the council explaining the prohibitive cost (£30 or more) and said that they should contact the GP themselves for the evidence. I don’t know if the council actually did ask my friend’s GP, but the HB direct to landlord was accepted. This is not any help to you or I if the Tribunal can’t be persuaded to seek medical info themselves re. cases.
    I’ll have my transfer from IB to ESA sometime in the future to contend with and probably find myself in the situation of fighting the A’tos’sers disability denial factory sham WCA report. Sometimes this prospect depresses me so much that I can’t function and have suicidal ideation.

    I wish I could come up with a better answer – sorry for your (our) plight. Regards, LR.

    I left a note for my GP regarding the charge yesterday morning re my circumstances as he is well aware of it and to my surprise I had a call from his secretary lunch time saying he said to pay £10.00, so I felt someone has listened to my plea and sure there are many out there who would if we try and ask.
    Try and stay positive, I know its difficult as I feel up and down too but feel when I think positive thoughts things seem to get better.Take care and good luck and keep posted on here you are not alone.

My GP has given me a very basic medical report which doesn’t cover even fraction of my day to day problems ( which he is aware of )as he reduced the charge for the report I have no backup of my medical evidence……don’t know what to do, also I have opted for paper hearing as oral hearing can take for ever, don’t know how long can I take all this stress.what is the right decision I don’t know as my WRO is pressing me to attend.I suffer with anxiety and severe IBS which triggers off when I am anxious.

    You say your WRO is pressing you to attend ? does that mean he/she wants you to re-apply for an oral hearing ?
    If that’s the case then agree, because you need to try and stall for time, and that time will be well spent in arranging an appointment with your GP again for the purpose of a proper medical report.

    A reduced charge from your GP in return for an inadequate medical report to present to the tribunal especially a paper hearing is out of the question.

    If money is tight (and if on benefits, what else could it be) then you could apply for legal aid via your nearest money advice or law centre.

    The monetery help from the state via the legal aid system is obviously to pay the GP etc.
    I was wondering why your WRO isn’t telling you this information, this is all basic stuff ?.

    Yes the welfare rights, ATOS, your GP, all those little DWP workers and Decision makers…the whole lot, they all want paid !!!

  72. I had to keave my job at a school in December I was suffering from Anxiety and depressing because of traumatics events involving special needs children. I made a claim for ESA I knew that I probably would not be entitled to payments because if a small shortfall in my NI contributions in 2008, but no one could tell me whether my NI would be creditted. It took 2 e-mailsto Ministers office in London and 3 letters to my DWP office to attain this information.
    I was went to a medical as I could not asceratin whether I should or shouldnt go-(because I wasnt not getting payments)- I paid £10 for a doctors letter and attached to the therapists letter- The “nurse” deemed me fit for work- Totally ignored the therapists comments and gave me 6 points.Its absolutely scandalous. I was knocked back that it knocked me back weeks and Therapist has bad to built me back up again.
    Im lucky that my husband is working and is supporting me, but I feel very sorry that the are doing this to people who are very ill and have no support.
    The money that my husband and I have paid in taxes and NI has done nothing when we need.
    I really find it breathtaking that the government get away with this- There seems nothing that can be done to highlight the plight of people.

  74. I’M not going to give you a long statement as to my ill health, just to say that if you don’t tell them every thing about your health and even if you do they do as they please
    The person who gave me an assement ignored every thing.I got no points alotted to me from the nurse
    just stated that I was fit to work
    I have a blue badge issued to me after an examination from the local Authority not just my doctor
    I was attending pathways to work but not alocated any V/work due to the way I am.
    For the appeal,I got all my medical records from the doctor ( cost me £50)and sorted them in order. I showed all the revelant stuff to the triburnal.I went to the tribunal and won my case .
    so please dont give up, Appeal even if your suffer from word blindness ( as you can tell by the mistakes in this letter I do )
    I have won compensation and They the D.W.P.got their monies back.
    Hope this helps some one out there who thinks dont bother and let them get away with not giving you what we are intitled to

There is something very wrong with our country when people who have worked here, paid their dues and then have to fight for benefits when genuinely very ill,whilst others new to our country get benefits thrown at them, you should not have to ‘,jump through hoops,’ to get what you are entitled to for such as cancer and other illnesses which will only get worse,it is to be deplored that you should not automatically be given disability payments and that the authorities are not more help.

    I’m afraid you are almost certainly going to receive bad news, but hey that’s what they are there for, to deny you your legal rights and therefore deny you your right to benefits, they will tell you don’t worry…because you can sign on for Job seekers allowance now that their Dr has found you fit for work.

Hello all, I,m so sorry for you all its bad enough being ill & in pain/distress,& then to have this hanging over your heads, I expect to be called soon.I have 8 diagnosed health problems .basically i,m up s creek without a paddle. of course i,ll be passed as fit for work by one of thses nazi like morons , but I,ve read all through & I know what to do .I will definately appeal..& find a way to take legal action against the ones that have caused all this ter.rible stress.To be honest I did feel suicidal ,but i,ve decided to give myself one more chance because you know why..its not my poxy fault that i,m unwell!!!.Just want to finish with some important advice as it might help someone..long story cut very short..man with cancer ,diabetic.too ill to attend so after a fraught couple of weeks Atos agreed a home visit. first thing, the ill man asked the :doctor :if he,d like to sit down on the sofa..the :doctor: said no..have you got a stool because I prefer to be above the person i,m talking to…second…:doctor : says i need to do a lung function test .but he had left it in his car. he went to get it …tried it once but it wasnt working & then chucked it on the chair…both major no no,s…he was passed as fit for work . benefits were stopped without warning…they then recieved a very stiff letter outlining everything…mnot only was his benefit reinstated he also got a letter of apology….its true ,i,ve seen it…Blast em out! dont let them do it to you…love to everyone…be strong ..I found my strengths from reading all your letters…..I,m not frightened anymore..they are just ill informed stuffed shirts…camerons boot lickers. does anyone know about the new cruel benefit rules for those with cancer? it sems well hidden?wonder why?

  89. Just re read my posts on here starting Jan 2010. In January this year I was referred back to a specialist after a fight with my Dr. I wanted more medical evidence after my appeal was refused as my benefits advice officer had appealed to the high court to have the tribunals case overturned. The Dr was not happy but referred me. Turns out that I have lung cancer. Had half of my left lung removed in March. This should have been diagnosed over 4 years ago when a scan showed a shadow on my lung but the specialist decided it was nothing sinister! My case has finally been heard in the high court and the tribunals decision overturned. I now have to go through another tribunal but guess what. WE CAN NOT ADMIT NEW EVIDENCE. I fully intend to send in copies of my medical reports anyway as I can not see how it is not relevant that I had undiagnosed cancer at the time of the first tribunal and when I had my ATOS “medical.” If this appeal is successful I will get back payments of incapacity benefit. I am now on ESA which was granted without the need for medical. Of course this will not last. No doubt I will be hauled in by ATOS again and we will start the fight again.

  92. Thank you for the link. will be useful as I am going to sort all the paperwork today and make an appointment with my GP and ask him for a supporting letter for the tribunal.
    Anna, the specialist who finally diagnosed me told me that the original specialist has retired. My new specialist asks me every time I see him if I am going to sue the NHS. I can not see the point in spending years fighting with them. If I had not failed at my tribunal I would never have insisted on seeing another specialist and I would probably be dead now so I just hang on to the thought that they may have put me through hell with ATOS medicals and tribunals but at least I am still here and fighting.
    Hopefully my next tribunal will be successful. It is quite interesting that the judge in the high court ripped the original ATOS report to pieces in his judgement and that I was given a date for new tribunal the same day that I received the High Court papers.
    One interesting point about ESA for the lady who had not paid enough NI contributions, if you pay the shortfall you are entitled to ESA. They omit to tell you this when they refuse your claim. Just ask the befits office how many payments you are short, phone your tax office and pay them and you can get your benefit. They pay you from 6 weeks after you have paid your back contributions.

  93. That’s right Carole, a DWP dirty trick, they send you a letter stating you are not entitled to contributary ESA because you haven’t paid enough stamps, but deliberately omit to tell you that you can claim for income related ESA.
    The way they word the letter is to give the impression that you are not entitled to anything other than Job seekers allowance.

Hello, I claim IS for myself and my partner, I have bipolar effective disorder 1 and my partner has chronic pain syndrome, my partner has had her form, I filled it in as she can not and she has been for her interview with Atos, 9 weeks on she has not had a decision regarding her interview, this is the first part of our problem, the second part is 8 weeks ago the DWP phoned me to check my details, my name, NI number, and informed me that they would send a form out for me to fill myself, on Friday just gone I received the form from Atos, now here is the issue, I changed my name by change of name deed over three years ago, changed all my benefits over to my current name, passport, driving licence, disability, everything like the deed by law states I sent the DWP my change of name deed 3 years ago because it states on there that I have to use my new name in all corresponding public and private in any paperwork, they changed all my benefits over to my assumed name to which all my letters for the last three years have been in that name, my benefit claim is in my deed name, the letter the DWP sent me saying they were contacting me about the change in benefits was sent to my correct name, the letter Atos sent me with the form to fill in was in my previous name asking for that name to provide details on my disability, I do not receive any NHS treatment or benefits under the name atos have asked for, and my deed says I am not legally obliged to answer the DWP or anyone working for the DWP because of the deed, in my previous name at all, I am very confused and do not know who to contact, what do I do i could lose my benefits because of this massive mistake by them?

  99. Re (65) Good news I won my paper tribunal hearing and have been awarded 18 points,don’t give up people…..still don’t know what happens from now on with ESA as not received anything from DWP, my GP has been supportive all through out the process.
    This forum has given me lots of support…its worth fighting for our rights, I did not choose to be made redundant after working 36 years and becoming ill with no prospects of finding any decent job at 57 when young people are struggling to find work.

  100. It won my appeal 3 weeks ago after welfare rights applied to the high court to overturn the first appeal decision. It has taken 2 years. I phoned the DWP yesterday because I had not heard anything. Nothing had been done. They asked me some questions over the phone. This is normally done by sending you a form in the post…which had not been sent yet. Phone them and ask them what happens next then your case will come off the bottom of the pile.

    My appeal was as awful as the first one. They had not received the new evidence that had been submitted. The Dr. was aggressive and insulting and I just cried. I was trying to tell him what had happened since the last appeal. He talked over me. I said that I had gone back to see a specialist and was told that day they were almost certain I had lung cancer. The Dr leaned across the table and sneered “but it wasn’t cancer was it” I said yes it was and he replied “so what kind of lung cancer was it then.” By this time I was totally confused because we had sent them all the medical reports plus a detailed Dr’s letter. I pulled the new evidence out of my papers and told him the exact diagnosis. At this point the Judge asked to see the papers and having read them she apologised and said that my appeal was being granted. I was asked to go outside while they dealt with the paperwork. On going back in the Judge apologised again but the Dr never even looked at me. I came home and sobbed for several hours.
    I only hope these Drs who sit in judgement on these panels treat their patients with more respect and understanding.

An OVERDOSE, Suicidal Thoughts, Depression, Homelessness – and yes, then there’s the ’causes’ of all of this; the failure of my viable business by a ‘failed’ government scheme, and the loss of my homes as a direct result of the previous failings that led to my deep depression – leading to SUICIDAL thoughts.

    One would have thought that such a diverse range of complicated, and Serious conditions would of had the UNDERSTANDING and SUPPORT from JCP/DWP. But, following a Medical Examination at ATOS, DWP STOPPED my ESA Benefit – sending my thoughts much DEEPER into SUICIDE!!

    My Legal Aid Solicitor di NOTHING but said they will wait for 10-months to represent me at the Independant Tribunal. APPALLING!! I, in my VULNERABLE state, wrote a 5-page letter to Terry Moran, Chief Executive of JCP, and since my efforts, JCP have now OVERTURNED the decision. Their minimal compensation will not do. I am seeking Legal Advice on the matter!

  105. Wow, this is a massive list of unhappy people… which I’m going to add to. I have had in a claim for ESA since June when I finished University. While there I suffered badly with depression and anxiety but being stubborn I wanted to finish my degree, primarily because I was doing it with my best friend and the only reason I could attend lectures was because she picked me up from home and went in with me every day. I haven’t really been diagnosed with one disorder, my counsellor believes I have PTSD, my CBT Therapist seems to agree, the ‘nurse’ from my ESA assessment seems to think I have sod all wrong with me. I’ll give you a mini rundown, I was attacked when I was 15, then got involved with someone who turned out to be a psychopathic paedophile who blackmailed, severely abused, kidnapped and eventually tried to kill me… forgive me if I’m a bit on edge but looks like according to everyone I should be over this by now (even though he was still stalking up until a year ago and the whole ordeal has been going on now for nearly 8 years! I digress. The nurse at the assessment sounds similar to others’ again I got asked stupid questions like what TV programmes do you watch, in my notes it stated I owned a cockatiel what bearing that has is anyones guess. I also liked the fact that she noted I wasn’t sitting shaking, and that I looked like I could wash myself. Yes I can take care of myself, that doesn’t mean I’m not suffering.

    Then we have my GP… good old GP, or not as the case may be. Apparently, if I can do a degree I can work, I might be anxious but I have to just ‘take the bull by the horns’ and get a job because ‘everyones nervous on their first day I mean don’t you [me] think I [Dr] was nervous you just have to get over it’ Sound advice! So my Dr is now stopping my sick notes because he basically thinks I’m lazy/a fraud or however you want to put it and as of Jan I’m on JSA. I still can’t leave the house but my GP did suggest I find someone to take me to work every day (yes because it’s really that simple). I get panic attacks in a work situation, can’t breathe properly I get dizzy, sickness. The thought of going to work every day terrifies me. My Dr refuses to put me on long term sick, I’m not asking for that I’m just asking for some help while I get myself better. I’m totally mentally and physically drained from the last few years trying to hold it together while really wondering if I would be better off dead, and the treatment from the Dr and the DWP has only made these feelings worse. Maybe if I take an overdose they might actually understand? Though I tried that once before and the GP basically said ‘well what the hell did you do that for’ in a voice that made me feel like a total idiot. I spoke to Citizens Advice who are getting a tribunal sorted which my CBT therapist and counsellor are supporting but without the support from my Dr I see little point.

    Can you change your GP ? I know it’s not so simple it just depends if you are in a city or the countryside. If you can change your GP do it and ask your new GP for a full medical examination, then get legal aid, they will contact the GP on your behalf and request a medical report, I know someone who has already done this due to the GPs biased attitude.
    You must appeal, it’s your right and will take at least six months or more to be heard so that gives plenty of time to get the report together, of course you do not have to mention to the tribunal you changed your GP, they will not know and will assume its the GP you always go too.

  107. ATOS medical care told lies about me. I fell over a paving slab whilst going to work in 2008. broked 2 bones in my right thumb and ligament. had a repair done. to cut a long story short 2010 lost my job. had depression, ligament op un succesfull. MAY this year medcal ass which fail, appeal failed and trinbunl 24 th nov failed. Aug this year thumb fused also arthritis in both hands. cant write and before anyone says you can type. NO it takes me some time. could not do it 8 hours a day. taken medication which makes me sleepy because of pain anti depressants tablets. CANT GET JOBSEEKERS BECAUSE I AM STILL UNDER DOCTOR AND HOSPITAL. Have tried harming my self, which i know is stupid. but not getting any money and not been able to pay bills.

    You had the assessment in may, when did the DWP say you were fit for work ? because from that date until six months have passed then you can apply for ESA again stating the reason as a worsening of your condition.
    In other words you do not need to sign on, you can apply for ESA as long as six months have passed from the time the DWP informed you that you did not have limited capability for work.   109. I did consider seeing another GP in the practice but I was scared they might go back to my current one and cause problems. I changed surgeries about 2-3 years ago from the one I had been with since birth because they had no female Drs so I’m not sure I can swap again. I’m a bit scared they might still think I’m fine, I don’t feel it but maybe they are right and I’m just wasting time or something I don’t know anymore. I’ll take a look at the forum thanks.

  110. You can go to any surgery you like, you don’t have to explain anything to anyone, if asked just say personal reasons etc.

  111. My last post was in September when I had won my high court case for Incapacity benefit I had a new appeal where the Dr was so aggressive even the welfare rights person with me was shocked. I had submitted a letter from my Dr and relevant reports from my specialists, even my histology reports. I was quite shocked when I said I had been diagnosed with lung cancer and the Dr said I did not have cancer.I produced my copies of the new evidence we had submitted. There were red faces all round and lots of apologies when they realised that the evidence was not in their papers. I won my case but the stress made me really ill, I did not stop crying for weeks and still get tearful when I think about it.
    I am now receiving ESA and yes I have to stay on this benefit. I have finally been paid my back money from November 2009 when ATOS declared me fit for work. The Macmillan Welfare Rights officer came to fill in the forms today BECAUSE I AM BEING RE-ASSESSED. So here we go again.
    I refuse to give up if they declare me fit for work again because this is what they want.

    The news today is that they are going to make people who are undergoing intravenous chemotherapy be assessed. There is a petition on the Macmillan website to stop this. Please can I ask everyone to go on their website and sign it and to pass it along to their friends to sign.

  114. i had a medical in august 2011 i arrived 20 minutes early and was kept there for over an hour .i asked the receptionest what the hold up was. she told me they were running late so i asked her to find out how much longer i would be. when she came back and told me it would be another 20 minutes i flipped and demanded a bed to lie on .she then told me i could go home and she would send me a new appointment out
    whaaaat are you joking my husband was with me and said i was wasting my time i could barley keep my eyes open i had taken double my pain killers to get me through this farcical assessment how dare they treat us like this. criminals have more rights than us i have worked all my life and i am entitled to this benifit now i am not able to carry on working. i eventually get called in . by a nurse who asked me did i feel well enough to have this assessment i told her to just carry on she then told she did not think i looked well enough to carry on then informed me i would have to go back to the waiting room as she did not feel qualified to deal with me .i near threw up i refused point blank she then informed me that she had to seek advice and that she could not leave me in the medical examners room on my own so i told her to get one of the 4 receptionest who were sitting there doing nothing .in the end she just went out and left us on our own i was on the verge of breaking down and told my husband that i was not coping well with all what was going on. when she came back she had a spring in her step and said she was fine to carry on
    i have osteoarthritus in my neck spine and lower back plus slipped herniated disc middle back (which i have been informed that there is no surgen in the country that will operate on because i would end up paralised) i also have fibromyalgia the list is endless but just the ones i have mentioned are only to going to get worse .there are no cures for them .anyway the nurse carried out her assessment it took over a hour . i refused to get on the couch and do the squats she then told me i was all done and i could go home i wished i could have vidioed the whole thing so you could see the state the whole thing left me in .i was in bed for quite a few days after this so called assessment .
    i never heard anythink untill end of october were upon i recieved a phone call from someone from the dwp informing me that i was no longer entitled to benifits as i did not score 1 point point (sorry but they do take the piss) so i had scored all the points i needed from 2009 untill i had this assessment aug 2011 its a miracle i am cured .she then told me i could claim jsa . now i know once i claimed jsa that i have agreed with there decision (yeah whatever ) i told her i wanted to appeal and i also wanted a copy of the medical( you have to ask for a full copy) when i recieved the copy of the medical i was insensed with anger how dare they .it was full of lies and inconsistencies . i immeidately got in touch with my local mp who asked me to write down every question that i thought was not right .well i did and more sorry for being so long winded lol this is the short version and i also appealed through my local unemployed center and got my gp on side .i was told it could take up to a year for it to go to appeal and that i would have to start sending sick notes in again .i was then put on the lower appeal benifit untill my appeal .well at the end of november i recieved a copy of the letter from my mp that had been sent to him not me stating that i had won my appeal and been placed in the support group . i still today have not heard personaly from them( dwp ) moral of my story is get every one on board to help you especialy your local mp if every one wrote to there mps and inendated them they might look harder at what is happening to the sick and disabled hope this helps some one

    This ATOS lot can’t get any people to work for them now and staff are leaving with the stress, how ironic is that ? the stress of working for ATOS Ha Ha. One of the Drs who assessed me was an old man with grey hair and decayed balls with one foot on a banana skin and the other in a pine box, honestly ATOS are so desperate they are reduced to taking retired Drs aged around 90, sad…….so very sad.

My friend’s grandson was summoned for an assessment at the job centre, not ATOS, but still a monumental balls-up….this guy is severely disabled, in a wheelchair, has the mental age of a toddler, can’t speak, my friend was so disgusted when she received the letter that she decided to actually take him. When his name was called, the member of staff gestured to his carer to come in, her face was an absolute picture when he pointed to the guy in the wheelchair, and said ‘Actually, this is Mr W’. They were swiftly ushered into a side room & profusely apologised to.

    I won my tribunal in Nov 2011 and received backdate money 7 weeks later, that was long enough but your still waiting after three and a half months ? that’s an absolute disgrace, you should probably send a letter again and remind them.
    By the way the quicker your paid the quicker you receive a new ESA 50 to fill in, I know because I’ve just received one and now I have to go through the whole process again…!!

Just wanted to say that a friends brother in law who has apparently worked for the dwp for 8 years plus , has left after no longer being able to cope with knowingly treating disabled people so unfairly,Cant say word for word because i dont know the actual person,only to say hello to.But this is what my friend told me and shes always honest..He has another job within the dwp but no longer does the mental cruelty processing thats how it was relayed to me…

  125. iv just attended a 3rd medical at atos,last time i had 15 points.but was refused esa.i was told to return to work.they left off copd(chronic obstructive pulmanary desease) angina,severe angziety and depresion.deaf in 1 ear.black outs and dizzy spells.asma,and renal failior.(kidney failure)and arthritus.so i was sent to work in the heart foundation.the next day i was sent to hospital,they diagnosed ostioarthritus in both shoulders,caused by carrying 1000,s of bags upstairs.i also severed my testicles.which i cant get an operation for,because i have COPD.iv just been told to go back to jca.ever though i cant move my arms

    I don’t know if you are aware or not, but you are/were entitled to appeal against their fallacious decision to find you fit for work.
    I hope you have protested with a complaint to ATOS and the DWP in the strongest possible terms ? if I were you I would be demanding compensation from them as well, more likely I would contact a solicitor who specialises in these types of claims, you should strongly word a letter of complaint to your Member of parliament, and don’t take or listen to any excuses from these people either. This is an absolute disgrace.

  128. got my reports from my medical assessment done by a nurse who has decided that i will be fit for work after just having surgery on my left hand a fortnight before and giving a statement that i will be fit for work in 6 to 8 weeks she has nod idea what the actual surgery entailed only that i had stitches if i had know would have got a sick note form specialist who did the op the recovery time for this op is 6 months as it includes cutting through nerve tissue and there is no guarantee it will work even in the short as it is a treatment not a cure but still she knows better than the specialists
    how on earth has this system been allowed as it costing more money than they are ever going to save
    been to solicitor to lodge appeal and even she cannot work out how i can get high rate mobility but suddenly score zero points on their sheet.
    the answers on the form when you read them sound yes i am okay
    the truth is that she has left things out like having to go next door if i want a bottle or can opening do not mean drink, mean milk and fool
    states that i can walk for half an hour to go to shop to pa\y bills
    does not state that before it would have taken five minutes
    said i get a bath but does not state that i stand up in bath do not sit down
    states that i can do my housework but not that it is does in bits not all at once
    thiis system is bizarre as have found out a person i know had to wait a year for an appeal
    regarding physical examanatiion that my left has normal strengh in it very strange as it is full of steel and my ankle moves normally strange when i try to do what she say she did i cannot do it
    also can clean bath but left out that i use spray mousse to do it do not bend to do it as you just rinse it off
    this joke of a medical would make sense if i had got some points as also have nerve damage to right thumb due a work accident and this is for life but that has somehow been magically cured
    now they have put our appeal court in the same building as the magistrates court so is this to make you feel more like a criminal?
    now the appeals courts have got such a backlog they are having to run these courts in different towns to try and clear up this unholy mess

    Well at least you know enough to appeal, you would be surprised how many people don’t even know that.
    If you only know one person that’s waited for a year for an appeal then you must be new to this ATOS business, if so welcome to your worst nightmare, you are now entering a world of hurt, and you are going to find out that you are not alone, there are literally thousands upon thousands all over Britain going through this hell.

    We are now in the world of a new Adolf Hitler, all news regarding ATOS through the media is ruthlessly squashed or at best hidden in the deep bowels of various newspapers, places where very few people visit, all claims of malpractice and fabricated medical assessments are denied on the spot by those horrible people in the new Nazi party, people like Iain Duncan Smith and Chris Grayling a pair of compulsive liars.

    The claims from people like yourself and others who come here with their stories about ATOS and the DWP are so fantastic that nobody believes them, and that is why you are just finding out about ATOS and the DWP even though it has been going on for over three years, yes over three years and if you asked the average Joe in the street if they knew who ATOS were ? the answer would be ATOS WHO ?.

  130. i think you guys need a laugh.i think this is crazy.i attended my 3rd medical at atos.the guy who examined me was dr steve gash,(registered medical practitioner)although i simperthised with his disability.i cant understand,how a doctor with 1 leg,is aloud to practice.his whole leg was amputated 11 years ago.he needed crutches to try to examine me.he told lies in his report.but guess what.i recorded my examination on my smart phone .he didnt know how to check my blood pressure.he tryde 3 times.added the readings together.then took an average reading.i dont think he was a doctor.the heath and safety issues are vast.he coudnt do a home visit for egsample.i think he was a legal team,or criminal lawer

I think that to employ the one legged ‘doctor’ was most likely done for a Psychological reason,s …you know like to make you yourself feel fortunate for maybe having two legs…So ,maybe you should not be there….Well. don,t feel bad if it is something like that…most health problems especially the more serious kind cant even be seen…And you can,t see pain either….

I have just got my assessment back from medical centre, and i would just like to say he just highlighted my good days and never even mentioned my bad days at all which made me look like i could probably sky dive lol. He said i declined examination when he asked me if it hurt and i said it did so he did not do it which is different from declining, unbelievable, i came out thinking what a nice guy but he stabbed me so far in the back it came out of my stomach. The system stinks you have to over state things to get your point accross. I think they should get your mediical records before they do these assessment as this person, totally ignored everything i had to say, my husband was with me as witness to this, if do go for this assessment i suggest you take someone with you to take notes on what he asks and your answers to the questions he asks, what a farce, hence obivoulsy after receiving full face to face assessment evaluation i am now going to appeal, i suffer with my back, but he has not once mentioned my back problem, i am astounded.

    Don’t be discouraged the appeal panels know that ATOS are lying, you can appeal and win, get that GL 24 appeal form and win that appeal, don’t forget to seek help from your nearest welfare rights office they do sterling work and will not refuse to help you, they can even represent you at the appeal.

    You are correct, ATOS do have targets, the Government not only love it but are ecstatic, I don’t think ATOS get anywhere near £1000 per examination though, but one day we will find out exactly how much, I think it varies and depends on what sickness benefit the poor person was thrown off.

  140. I too am going through the appeal process for both ESA and DLA. I was on IB and have been found capable of limited work and placed on the work list. I was previously receiving DLA HIGH RATE FOR BOTH! Now I’m entitled to none! I have just had to move into an adapted bungalow due to the accidents and falls I encounter on a daily basis. The medical evidence I received from the DWP was innacurate and in some place contradictory to previous questions answered by the DR. I supplied a report from my neurologist , which to be honest, I don’t think could have been opened, never mind read! The person giving advice to the decision maker was a Nurse, who Had never examined or met me!…
    The ESA MADE THEIR DECISION without an examination or even an interview at the job centre or by phone????? I have had previous dealings with ATOS and finally won a my fight for retirement due to ill health…Looks like I’ve got another two battles ahead of me…Wonder if I’ll still be alive to witness them, as judging by the comments I’ve just read, the appeal dates are getting longer and longer. I can no longer get out as my mobility car has gone and I can’t access public transport, even if I could afford it. What a future! Good luck to you all

My partner has Primary Progressive MS, All that he can do is be honest on how the MS prevents him from working, it is awful there is walking (he can manage to get to the bathroom most time), incontinence, forget to mention cognitive problems such as slurred speech at times, forgetting and mixing up letters word and numbers.

    Sometimes I am afraid because he will have the medical assessment, however we are arranging to have it at our flat, we asked atois representative and they said that we need a medical note from his GP and label it as requested further medical evidence.

    We are also Nichiren Shoshu Buddhist and we believe in the (edited by DWPex admin) best English translation by Burton Watson, it shows a better path to take and the Buddha does not want me to be afraid so I am sure we will get what we need to pay our bills be able to eat and live.

    If your GP faxes through the evidence regarding your husbands health condition then I’m sure they will agree to a domiciliary visit, the very worst that can happen is having to appeal a fit for work decision, if that happened then the assessment rate is available while you wait for the appeal to be heard so you will not starve.

Hello all, I,m most probably late with this report as always thats because i,m useless on the computer but just in case it has been missed by anyone…check out penman & sommerlad investigate …..mirror.co.uk its about all the deaths of people being passed as fit for work,,..shocking.,.one comment states institutionalised murder that needs to be reported to a body of authority like the police..thats what it says…anyway I read all the comments and then composed myself to put the message on here ,,I could not stop crying..There is another comment of a lady being passed as fit for work that had a hickman line because she had cancer. she died the day before her placement….CAMERON ,GRAYLING,IAN DUNCAN SMITH ,ARE MURDERERS!!!

Hi my name is Paul I had my medical last week got there 10minutes before my appointment time of 11.10am went to reception gave my details and the woman at the reception said we have not got you down for today! did you arrange an home visit? I replied no i did’nt so the woman asked me to take a seat while she investigates.

    I took a seat shaking feeling nervous & confused and wondering what on earth was happening? after 5 minutes or so the lady retuned to me and said further medical reports have came in about myself and that i will never need another medical ever again, in disbelief i asked her to repeat and she did so i left the building without even having a medical.

    It was good news but i was left wondering why i was’nt informed before as to save myself a long journey for nothing.

    When i got home i rang DWP and the local dwp told me my benefits were safe but could’nt really tell me why my medical was cancelled so i asked could they put me through to someone who did know what was going on, They put me through to dwp up the country somewhere which was probably the main office and i spoke to a another woman who told me that they cancelled my medical because they read my medical form i filled out seen the doctors evidence and evidence from my councellor who i have seen for about 12yrs and decided i did’nt need another medical.

    I asked why they could’nt inform me to save me the long unnessasary journey to which she opologised. I also told her atos said i won’t ever need another medical again to which she replied yes i will in about 2 years time, i don’t know why 2yrs? as my symptoms will just be the same if not worse.

    There is hope people so keep your chin up and make sure you got the evidence from Dr. etc.

    I suffer from post traumatic stress disorder, anxiety etc after 14yrs of mental and physical child abuse and my result was a big weight off my shoulders.

    I went to my medical thinking the worse but got a good result so there is hope.

    Well at least you have a result, your right though to be wary about this will never be assessed again for the rest of your life business, expect the worst, but it shouldn’t happen for a while at least.

  150. @dwpexamination, It’s very sad the suicide rates and what dwp and atos are doing to the sick and disabled should be crimes against humanity! I firmly believe that all the wars, afghanistan, iraq, libya is what has made our country skint as war is very expensive with cruise missles alone costing £500,000.00. It’s crazy in the 21st century that disabled and sick people are treated this way!

Hia, i went for a medical with ATOS back in Sept 2011, i was told by the Dr that i would have my report back in three weeks, weeks and weeks went by waiting for the dreaded brown envelope to land on my mat, well jan 2012 it landed, but it wasn’t my medical report it was a letter off the DWP stateing that i’d been put into the work related activity group, and it said on it if i didn’t aggree with the decision i could appeal, so i did. My daughter wrote them a letter as i suffer with depression and she signed the letter, it took them nearly 6 weeks to reply, and that was only to say that they needed me to sign the letter, which i did and sent it back to them straight away. In the meantime i have had to attend work related interviews at the job center, which i find really hard to do as i don’t like leaving the house, well last week i received 2 letters stateing that my benifit would stop on jan 17th 2013, still no answer to my letter mind!!!! Well my daughter rang the DWP to see what this was all about, and she was told that they had made a decision that i was to stay in the WRAG, but i hadn’t been informed by them in any way. She also asked them to send me my medical report, which the man in the DWP replied…WHAT USE IS THIS TO YOU!!!! my daughter told him that i needed it to make sure that ATOS hadn’t lied, as they have lied on a previous medical, and she was told eventually that he’d get it sent out to me. Well Sat morning a brown envelope landed on my mat, it was my medical report!!! Hooray!!!!!!! and on it it stated that the dr in ATOS had put on my report that it was unlikely that i would be fit to return to work for at least 2years!!!! No wonder they weren’t willing to send it to me…… if i hadn’t had it they would have stopped my benifit next year….We have written a letter to the DWP asking them to explain this… i wonder what they are going to come up with, the lieing BASTERDS!!!! I would like to tell everyone to ask to see they’re medical reports, as they have got to give it to you.

    Be careful here, you say they have put you in the WRAG and your benefit will stop on Jan the 17th 2013, which suggests to me that you are on contributory ESA and not income related ?, but the HCP has said you aren’t fit to work for 2 years ?.

    Well if the HCP has told the DWP that you aren’t fit to work for at least two years that means you should be in the support group (Or good chances for the support group) not the WRAG, if you stay on the WRAG then your money will indeed stop on the 17th of January 2013.

    I hope you can understand what I’m saying ? and that is you need to appeal to get in the support group, and you have strong evidence from the HCP that you should be eligible for the support group, now that the DWP have been forced to show YOU the ESA 85 you can see what they are trying to do, they hope you will not know that your money is going to stop if you are on the WRAG, they hope you will think you are secure on the WRAG, and they hope you will not appeal to get in the support group because if you appeal and win then as long as you stay in the support group of ESA they cannot get you off it even if you are on contributory ESA, at least until you have another assessment.

    I would strongly suggest you take advice on this, either from the CAB or the welfare rights, do not delay any longer.

I am soo confused, do you remember in my post number 148 i explained i went to one of those so called atos medicals, when i got there 10 minutes before my appointed time i rang the buzzer gave my name etc went to reception gave my details etc and the woman on reception told me they have’nt got me down for a medical today and asked if i arranged an home visit?
    To say i was confused was an understatement, I said to her i have a letter for a medical for today so she asked me to take a seat while she investigates, I was waiting only 5 minutes when the woman finally approached me and told me that they have recieved extra medical evidence and that i never need to come to one of these medicals again, In disbelief i asked her to repeat and she did.
    I felt happy what i just been told but felt annoyed attenting the medical centre when i never even had an appointment on their system yet they never even bothered to send me a letter or call me to let me know to save me going 6 miles to the medical centre.

    when i got home i telephoned my local job centre/D.W.P centre explained what happened and they said after looking on the system that my benefits were safe but they could’nt tell me why my medical had been cancelled so i asked them to put me through to someone that did know.
    They put me through to what must of been the main office up country and after explaining the situation to them they said atos contacted d.w.p and said after reading my medical form (esa50) and evidence from my doctor and councellor they decided i did’nt need a medical, i told them what i was told at atos that i would never need another medical again to which she replied well that’s not entirely true you may not need one for up to 2years.
    I got a telephone call today from d.w.p and a woman asked for me and she said they have put me into the work related e.s.a and that i have to attend appointments but she said someone like myself would only have to attend around 3 or 4 times a year.

    I told her of my dislike going to my medical at the appointed time just to be told to go away when they should of contacted me to say they cancelled it and no need to attend and that i was unhappy with atos decision without even seeing me or interviewing me and no medical, how can they make such life changing decissions with no physical contact with myself???
    I feel as if they are lieing to me and not telling me the full story hoping i will fall into a trap whereas i wont be able to appeal etc if i don’t appeal in the 4 weeks .

    Atos are a complete waste of space and they are not even medically qualified to deal with the people they medical., I feel i am being constantly lied too and purposely being made to feel confused and they constantly move the goal post in their favour

    Surely they know of the stress they are causing people and over 1100 people have comitted suicide and numbers are rising, I hope ian duncan smith and others responsible are eventually charged with crimes against humanity.
    Any advice on what i should do know will be greatly appreciated!

  159. Your on income related ? well you should get the ESA at least until you are called again.
    Anyway, they probably think you are happy to be on the WRAG of ESA if you aren’t happy then you can appeal for the support group, obviously that’s your decision but take advice from the welfare Rights or the CAB Paul because if you apply for the support group and lose that appeal then you need to be aware that a tribunal have the power to deny you ESA altogether.

    Believe it, but check it first if you do decide to appeal for the support group

  161. Hi, I also have had problems with ATOS. I had an assessment back on 31st October 2011. I heard nothing else from ATOS or from the jobcentre until i got a letter saying i had to have an interview at the jobcentre.. so i went down had the interview and got told i had to attend Best Training. I asked why since my problems ive had have been going on for over 7 years they wont magically disappear. The person who did the interview just said that the law required me to go to Best Training. So i attended there to be told by Best Training not the jobcentre that i have been put in the Work Related group and that the job centre expect me to get a job within 3 months.

    Now i worked from the age of 15 until 7 years ago when i got diagnosed with Epilepsy. Ive had Psorisis all my life which flares up more when im stressed, as well as Depression which ive had from the age of 13 because of abuse,Borderline Personality Disorder and severe migraines which ive had for the last 6 years constantly. I told the guy at Best Training and he said i had to appeal.. so i did 4 times now and they keep ” Losing ” my appeal form.
    Doesnt help anymore now because i also lost my hearing completely in my left ear and partial in my right ear due to Meniere’s back in January and i dont go anywhere unfamiliar on my own because if i take a vertigo attack while im on my own in an unfamilar place i end up freaking out and end up making myself ill. My fiancé tends to come with me everywhere because since i lost my hearing i’m more of a danger to myself now because i cant hear traffic and stuff yet supposely im eligible to work which i find complete BS.

    ATOS have no training they only look for ” PHYSICAL ” problems they ignore the mental ones. Which well for a group of people who claim they are medical then why are they not taking the Mental side into consideration and only looking for physical problems.
    They asked me what did i do in my spare time. To which i replied with depends what kinda of day i’ve had.. If ive had a siezure at night i tend to sleep all day because it physically drains me. Other than that if its a normal day with no headaches, no siezures and no Vertigo then i can essentally be ” normal ” however in the last 7 years ive had maybes 17 normal days… The rest there is always at least one problem. I tend to try and keep myself busy as much as i can as i hate sitting around doing nothing.

    I’m sick of these idiots having peoples lives so to speak in thier hands and screwing everything up.

    If they ask what you do in your spare time again just say ”Well I get up at six o clock (Around the crack o dawn) and start on the punchbag (I imagine it’s a stupid bastard like you that asks daft questions that I’m punching) followed by 12 rounds of boxing with my personal trainer, after that I swim for around an hour in my private swimming pool, then I do 100 pushups and by the time the evening comes I’m exhausted and I just fall asleep until the next morning then the whole rigmarole starts again”.

    So what did you imagine I did in my spare time ? you knob end.
