Assessing ATOS

NOTE; I received a suggestion on the number of points and how they should be awarded, the form has been amended accordingly. I have also reproduced a contact form for recording the content of calls with the DWP or ATOS.

When a disabled person attends an ATOS “Medical” , they are generally in an anxious state and often forget some of the things that happen during the alleged “Medical” examination. This can often lead to confusion when appealing against the inevitable cessation of benefit payments and the ensuing chaos it causes. To make matters worse, when one attends accompanied and notes are taken it is sometimes difficult to keep up with what is happening. To help in the alleviation of these issues I have developed the following method of assessment which I will be asking my companion to use if I ever have to face these people again. Any comments would be appreciated, if you think I have missed, or you would like to add anything please do so, it can only help. In developing this document I took into account my own personal experience of ATOS, their documentation and the opinions of other disabled people I know.

So there you have it readers, a possible aid to the disabled when under pressure from ATOS Origin, and a way in which we can help each other to remember important details of our individual examinations. Oh! and if the alleged “Doctor”  asks to go through your answers to check for any inconsistencies, tell him you don’t have time and he can request a copy of your report by post. By the way, if you are wondering what use this document is, I can tell you, it can help make a balanced judgement on those employees of ATOS who cause disabled folk so much stress. So I must warn you, fill in the form honestly, fairly and objectively, as you may need to rely on it at your tribunal. Oh, and if you like you can send me the bit relating to the assessment centre for publication on this blog.

  3. Im going to a medical tomorrow with these scam artists.
    Im bringing a video recorder, i will be recording my journey to the interview, as well as verify the date with newspapers etc to prove i actually attended.

    Im going to record the walk to the centre from the nearest car park,i will end recording once im at the building.

    Once im in with the doctor im going to make him aware that i will be recording as the last medical i attended the guy out right lied about the answers i gave and doctored it so i recieved 0 points!!!
    If they refuse for it to be recorded i will also record my eviction from their building once again proving they refused to examine me,not that i never attended.

    Im not looking forward to it…im pretty sure they will tell me im not allowed and try and stop my benefits…oh well :(

  4. Its very likely you will be asked to leave nd have your benefits stopped, dont punish yourself, you just become a statistic, have no right to appeal and will have to wait 6 months to re apply. I know it is an annoying situation but if you can take someone with you to take notes its much better. If you are going to record your examination, do it covertly, dont tell them you are afterall, they tell you a pack of lies. We need to fight them in the way they fight us, we need to use every means available to us to defeat these benefit robbing fools. Take a look at the assessing atos page and pront off the assessment form, it will serve to remind you of your visit if anf when you appeal. One thing though, you could lose your benefits anyway, why lose the right ot appeal immediately by antagonising them? Play the game cautiously its much better for you that way, if you are on esa and appeal you can ask to be paid at the lower rate untill you get to the tribunal too.     Have you considered asking for help fromthe CAB or your local authrity welfare rights officer? Reading your comment you sound as though your father is actin alone on your behalf. It is always wise to have help when dealing with the DWP and thier enforcement arm ATOS. I have produced a contact form on the assessing ATOS page, print this off along with the assessing atos form. Keep the contact forms near the phone and make notes of any conversations you have with either, this is important as you may need to refer back to previous calls. The assessing ATOS form can be used to carry out an assessment of the medical you receive from the ATOSSER and serves as an aid to your memory if or when you need to appeal. Ask your GP to intervene and request a home visit from ATOS too. I know its stressful, but it is always wide to challenge any decisin made by ATOS as they are all suspect, 40% of appeals which reach the tribunals service are being found in favour of the appelant, this means ATOS are wrong 40% of the time.     Joes right Amanda, dont panic. Tell you what though, a description of the centre would be useful especially if you can tell us about the nearest parking facility. Be under no illusions when you go in, get your husband to help you by opening doors and when sitting or rising, remember you are under observation from the moment you come within sight of the building. If you are interested I have produced an assessment form you can use to remind you of the events of the day, its available on the assessing atos page. The alleged doctor will try to tell its no use taking notes as they cant be used at a tribunal, its utter bollocks and anyway they are to help you recall the events on the day. Gwet your husband to fill it in, word is they are terrified of it. Also if you think your doctor has not got a reasonable level of english or you cant understand him her we would like to know about that too, if they try to bully you in any way, become agressive, or you feel thier attitude was unusual then make a complaint about the doctor. ATOS hate complaints as they have to investigate them, it costs them money and keeps thier admin staff busy thus hits thier prfit margin. We need to hit them where it hurts as they dont care a toss about us.

  7. Hi, I am taking my son to an ATOS assessment on Tuesday. He has autism and is already stressed; having made several suicide attempts previously. I am asking ATOS to make reasonable adjustments – no waiting in a crowded room, quiet, for him to take frequent breaks every 5-10 minutes to de stress and most important – not to leave him waiting. I have my doubts and I am taking full notes for the NAS & AWM.
    However if what I hear about ATOS proves true, I will have a fight on my hands – and they will know about it.
    I thought wouldn’t it be great if a number of volunteers could ‘picket’ the centres with a small leaflet for those going in with useful information such as getting infomation, copies of CTV, notes, qualifications – where and how to complain effectively. Nothing untrue or defamatory and if ATOS are as good as they claim they would have nothing to fear by this information – would they? It might give a little comfort and hope to those who are passing through the doors.

  8. Well good luckat the assessment centre on tuesday, by coincidence I have an appointment for that (3.30 pm) day as well.
    I’m taking a note book with me and when asked what the writing is for ? I will explain it’s some notes to help my memory for the coming appeal !!. LOL.

    Anyway picketing an ATOS centre, handing out leaflets and exposing their crimes, good god are you trying to ruin them Sir. LOL.
    The police would be there in ten minutes flat demanding you leave, the reason ? well it’s private propery Sir, or some other nonsense of an excuse.
    Of course they have everything to fear from this information, because they are a self-serving profit making organisation, and are in the business of corruption and in it right up to their neck.

    We also wish to thank you in the way you are helping the genuine sick, it’s true what you say because I work for the DWP and have seen what the decision makers are doing to people with real health conditions, they even laugh about it in the canteen it’s absolutely horrible and I wish I could speak out, but I would lose my job and never work again, they would make sure of that, I feel like crying sometimes, what kind of people have we become ? all I can say is not everyone who works for the DWP are scum…SORRY JUST WISH THERE WAS SOMETHING I COULD DO TO STOP THIS MADNESS.

    Thanks very much for confirming what we all know, it’s refreshing to see someone from the DWP having the courage of their convictions, yes I know you are bound and gagged, I know they have a bullying culture in the DWP, and I know if you dared tell the truth they would make your life a misery, your e-mail was absolutely heartbreaking and I wish I could show it here, but I respect your wish not to be exposed publicly.

    I hope you are going to appeal then, because you can win easily, and while waiting for the appeal to be heard you can apply immediately for the assessment rate which will give you some money to live on.

  17. Simples, USE THE COMMON LAW, which we and everyone else HAS to abide by, including ATOS and the DWP personnel. Forget legal, that HAS to CONFORM to the Common Law anyway. One way to fight ATOS is to simply charge THEM a fee for your services. They are asking that you answer their questions. HANG-ON!! What is in your own mind is YOUR intellectual property, you are under no lawful or legal obligation to provide the information they require free of charge, or to put that information on the form for free, or even put YOUR signature to it for free. THINK, do bankers, accountants, soliciters etc give their intellectual service/information/signatures for free? ABSOLUTELY NO CHANCE. They charge you a kings ransom nowadays for their services simply because they are lawfully and legally entitled to do so and they DO IT EVERY DAY and get bloody mega-rich. AND YOU, BEING EQUAL IN LAW, ARE PERFECTLY WITHIN YOUR RIGHTS TO CHARGE FOR YOUR KNOWLEDGE AND SERVICES also, SO DO IT. Think; if “A” promised “B” that “C” would do some act or other; then is “C” lawfully or morally obliged to keep that promise that “A” made to “B” (which may well be without “Cs” prior knowledge? NO !!! Then in that case, if the DWP promised ATOS that benefit claimants would fill in their forms for them free of charge, then tough crap, because benefit claimants DIDN’T MAKE THAT PROMISE and are ABSOLUTELY UNDER NO LAWFULL OBLIGATION TO DO SO just because some government dep’t told (or threatened) them to.

    ALL national and local government departments bully and intimidate us into thinking we have to provide our services for free, I.e. sort out the domestic green rubbish for them to collect. That is by definition, a “provided service” that they expect for free, would they employ someone to do the same job and expect not to pay them a wage? Write to ATOS and inform them THAT YOU WILL give them the required information, THAT BEING, “YOUR intellectual property”; YOUR Time (filling in the form) and YOUR signature (worth a fortune to them because it makes the form a “contract” that is binding) for the sum of…£xxxxxxxxxxx….whatever you think it’s worth; but make it enough to retire on with plenty of zero’s to spare :o). For those who have lost their benefits, just make the complaint that you WERE KNOWINGLY DECEIVED and that the information obtained from you was by fraudulent means, prove that and the initial decision will be overturned by default and compensation the order of the day. Try the Compensation-4-You law-firms, they’ll be licking their lips.

    They can’t stop your benefits because you haven’t actually refused to fill in the form and DWP can’t do so for the same reasons, (if they do, then they are “In Breach of Contract” as in “The DWP states that “the law says you need XXXX amount to live on per week” and there is a pre-existing contract with the DWP for THEM to pay YOU those benefits” you should have a WRITTEN STATEMENT from the DWP to that effect somewhere. After all, ATOS has received a 9-figure sum of money (300,000.00 I believe) to carry out their fraudulent activities. All it needs is a standard letter template, A NOTICE, so everyone can write them and ask to be paid for your services. It will completely screw them up because it is a perfectly LAWFUL (and legal) request.

    Also, explore the COMMON LAW “Commercial Lien”, If someone (anyone regadless of status, rank etc) does you mental or physical harm or causes you loss (all tenets of the Common Law) can be slapped with a Commercial Lien, It is Human to Human thing and does not need a court or lawyer (if you know what you’re doing), nor does it cost anything other than a “Recorded Delivery” letter to the recipient, to implement them, but has to have a judge and jury to remove it from the person its aimed at. You (MUST) state the truth of your matter i.e. you were wrongly assesed and refused rightful benefits by a dodgy process (which is what ATOS is all about). then state your amount of compensation with a 30 day pay-up or go to court. The Commercial Lien is a very powerful tool and scares the bloody shit out of ALL government departments. All those who feel they have been wronged, go to the CAB, free solicitor etc and get the facts and hit the so-called “ATOS Healthcare professionals with it.

    If you’re up for assessment, ask the name of the “Assessor” and inform s/he that they risk a Commercial Lien if their “Assessment does not agree with NHS clinicians and their recorded facts/diagnosis. They can’t have it “both ways”. It goes like this: If NHS Doctors/Consultants have diagnosed an illness/disabilty and declared you “Unfit for Work”; and then ATOS “Healthcare Professionals assess you and then state the opposite, then someone has told you porky’s (unless you have deceived the medics). If the NHS Clinicians has wrongly deemed you unfit for work and you have believed that and stopped working, then you have given up a lot of money in lost earnings, (court case etc) if ATOS is correct of course. If it is that ATOS is wrong and your NHS diagnosis is correct (a statemenmt of which, can be obtained under the “Freedom of Information Act”, then the NHS staff must defend their professional integrity or risk being taken to court themselves. If the NHS are proved correct, then that will prove ATOS have attempted to defraud the benefit claimant. Just work one against the other and let them shoot at each others foot :o)

    Those are my thoughts, I could be wrong, but its worth thinking about and exploring further.

    I have to admire you because obviously you have done a lot of thinking on how to legally beat these criminals, your suggestion to not fill in the form ESA 50 is perfectly legitimate and you do raise some good points as well, you have probably worked out by now that to prove this legal action will have to be taken because take it from me they WILL stop your benefits, when it says on the letter which accompanies the ESA 50 your benefits MAY be affected if you do not comply, they don’t actually mean the word MAY they mean the word WILL and taking them to court is probably a winner because the evidence of their corruption is overwhelming and more than enough to convince any judge even a corrupt one.

    Since you will not be getting legal aid when you attend your litigation attempt on ATOS healthcare and therefore the British Government, there is the little matter of finding around a million pounds or so to ensure a smooth win.
    DO YOU HAVE A MILLION POUNDS TO SPARE ?. Maybe we can ask Veronica ? I doubt very much if she would even bother to reply JIM.

  19. Have put a FOI request into the DWP and i have not even been seen by ATOS yet.
    Sent them a big parcel of hospital letters from 6 consultants, the package cost me £4 to send, but i dare say that none of the letters will be taken into account,, have severe crohns disease with adhesion’s,chronic pain to the bowel adhesion’s,Hiatus hernia causing daily gastric pain, with esophageal reflux and gastritis, severe RLS, and depression and anxiety caused by chronic pain, but i am sure i will be forced back to work after a year.
    Great i am a nurse and they cannot make any adaptions.

    Have you heard of any cases where the person has not had to go for a medical because of all the documentation they have sent from hospital consultants?
    I doubt it if they can turn cancer patients down.
    They will have a job on their hands, if i can beat Social Services they will have a real job on there hands.i will probably be a blithering crying idiot on the day of examination.brilliant website, do you get much spam to your site?

    Yes I’ve heard of cases where people haven’t had to go for a medical but just received a letter from the DWP saying they are entitled to ESA and so on, but this is only just recently and the reason I believe it’s happening is because of the enormous pressure that’s been brought to bear on ATOS, they are struggling to cope as it is, what with all the new customers (sic) they are herding in there, not only that but the various blogs and forums like this http://dwpexaminations.blacktrianglecampaign.org/phpBB3/ amongst others are creating absolute havoc for ATOS and the DWP.

    LONG MAY IT CONTINUE, BECAUSE THREE YEARS AGO VIRTUALLY NO ONE WAS EXEMPT FROM AN ASSESSMENT, THEY HAD FOLK IN THERE WITH BRAIN TUMOURS, LUNG CANCER ETC AND DECLARING THEM ALL FIT FOR WORK, AND GETTING AWAY WITH IT TOO, THAT’S WHY THIS BLOG AND THE SISTER FORUM ABOVE WAS STARTED TO TRY AND STOP THESE CRIMINALS FROM DAMAGING ANY MORE PEOPLE..!!

Do you mean the ESA 50 Allison ? because if you do mean the ESA 50 then it’s a month you have to fill it in and send it back, sometimes they phone and remind you even if you have only had the form for a couple of days, I just say to them politely YES I’M FILLING IT IN, WON’T BE LONG NOW. Then I put the phone down and give a one fingered salute…LOL.

    On the sister forum one of our members put in an FOI asking who investigates the complaints against ATOS ? the DWP replied that it was not in the public interest to inform anyone who is responsible for complaints against ATOS, in other words it’s a secret…What they like ? a bunch of jokers they must think we are idiots and incapable of working it out for ourselves…LOL.

  25. Yes the main questionnaire you have to fill in.
    Got a letter from Atos on 30th January 2012, stating that they had not received by questionnaire, it was not due back until 8th February.
    The large package of medical notes, questionnaire, was sent by recorded delivery on 30th, they received it the next day.
    I was waiting for a hospital letter to arrive.
    I suppose their next excuse will be they have lost everything.

  26. Yes an ESA 50 Questionnaire, I’ve just received mine this morning and have to return it by 14th of March, but I’m really slow at filling mine in (Used to be really fast at filling them in, and heard from them immediately) so they should receive mine around the 14th of March.
    I was only informed I was entitled to ESA three weeks ago !! And they are on my back already, but I was not disappointed because I have already psyched myself up with mental Anti-ATOS training over the last three years…..LOL.

  31. no been and gone. i forgot the best i had a appoinment not long after coming out this is the best bit after getting there atos swansea branch i get to sit in the waiting room for a bit .then called by a nice lady so my wife said anyway wife sits then as i put my backside onto seat the person who was interviewing me said she had phoned neath general up and then cardiff and the doctor she spoke to had told her the inplant had gone well and i would be fit for work in a few wks time.well i asked her was she a doctor no a nurse well i said get real one in .well the outcome was a i had it stopped and a new one made four wks later so this is now six wks after op not two like the other one.which was about two wks but i felt ok.but the second one was by another nurse and they had promised doctor but i had caught some stomack bug day bfore and just wanted it over with .but the outcome must have been i had 15 points as my money has not stopped and its been about 8wks.in the mean time ive written to my mp p hayne and had a reply of the dwp minister saying atos was doing a wonderful job and they had not known about my op or they would have waited a few wks bfore calling me and a few more lies in their reply to said minister. well after the reply went and sent another email to haine but no reply so sent a few times still no reply.in the mean time back in again lead inplant in top part of heart loss so anther op to put it right this time told no out for a while .so left out the following day friday after op anyway following wk i walk to neath and p hains office and speak to his secetary who i strees why havent he reply to emails well return home no harm done. the following day get a phone call from job centre that i had a interveiw monday with them but i didnt have to attend it could be done over the phone

  33. yes ive asked haine to ask dwp minister why did atos lie when they said they didnt know about my op .and why did they not say this was the second time in a month i had been to them and bless them for travell by car twenty miles they give me five pounds petrol money which is being framed and put on the wall jeff ( yes i had come out of hospital the first time and went to their appoinment but i felt ok }as it was only pacemaker surgery and didnt feel to bad it was the second op that did me jeff

  39. am a reg member on that forum ive posted so many sites ive forgoten whot ive said pluss with my memory loss it makes life interesting as i cant say that i said it as wife tells me i had .but now a letter end of wk stating my contrabution esa is running out at the end of the month and should phone this number up to find out whot is happening or whot i can claim now if anything so have to wait and c and bcause ive got a pacemaker inplant have been put in wrag group even though im still under the hospital as i had the first implant taken out as of trouble with it and second one done but that leaves me with pain in chest and had to breath which makes walking some days bad but not to worry i could be working in the next few wks if the goverment get their way

  40. i am in dispute with my GP, with reference to poor practice which has resulted in myself needing surgery, i am in the process of changing GP, so i was waundering if it would be acceptable for my to supply a written letter in support of my ESP appeal from my new GP at a later date,? i do not think my present GP would do me any favours, with submitting a report from him, i have got the bundle to handover at my DWP tomorrow,with reference an appeal to go into the support group for a few months insted of the WRAG group, i suppose i am lucky in the fact that i received my medical report from the DWP last Monday, and my paperwork for appeal has to be in by

    Have you tried firefox ? it’s excellent, I had similar problems with IE and so I just binned it, with firefox it’s free and no problems, and I downloaded ‘Do not track plus’ which stops all those idiotic adverts etc, that’s free too.

I attended a work related interview two weeks ago and was told by the adviser there to sign off ESA as i was now a voluntary client, due to them only paying my national insurance stamp, my contribution based esa was stopped on 30th April 2012, as i had been on it for a year, couldn’t get income based esa as my husband is working full time.
    After being put into the WRAG group with 18 points post atos examination in April 2012, i decided to put an appeal in to be placed in the support group for 6 months, i had new medical evidence post surgery to add to a very large bundle, which contained medical evidence from 5 consultants, documentation for the past five years,i didn’t send in any supporting evidence from my GP, but said i would add that at a later stage.
    To by disbelief a brown envelope popped through the letter box this morning, wow i have been put into the support group for six months, and that was after reconsideration, without even going to tribunal .
    The thing is my WRAG adviser said that i would have no chance with being put in the support group, and that group was for individuals that would never ever work again i told her i had no intention with reference to closing my claim down.I HAVE WON AND IT IS DOWN TO ALL THE SUPPORT I HAVE RECEIVED FROM THIS WEBSITE MANY THANKS.
    I must admit that i had put a very impressive court bundle together, but expected to go to tribunal, and would of represented myself LIP, but with the help i have had from you guys i would be very happy to assist others with reference to appeal and putting their documents together, even though i run a national support group with reference to family court injustice, i would still be prepared to advise others, i have had one or two good days as of late, so please feel free to contact me,
    My co workers at Parents Against Injustice are keeping things together there while i am ill, but please please do not hesitate to contact me.

    People need to know their rights, what they can and can’t do, so any help is welcome, at the moment the DWP have every advantage there is, it’s all very one sided.
    Everyone needs to understand, ATOS are a criminal organisation, there’s no doubt about that, and the DWP know this but still use these bent so called medical assessments to terrorise and ruin peoples lives, as far as I’m concerned they are just as guilty and just as criminal as ATOS.

  64. We have a home visit tomorrow :(

    So far:-
    - WCA gave 0 points and the report was a complete fallacy of what actually happened. ATOS later said it wasn’t up to their standards but have refused to comment more on a point by point complaint. (restored on appeal)
    - Previous ATOS medical report was so easy to prove it was so incorrect. They even said that the consultant’s report was ‘not medically reasonable’ !!!!

    For anyone else suffering ATOS, I definitely recommend writing a complaint to the DWP (not ATOS), copy it to your own mp and to chris grayling. Keep escalating the complaint and don’t be fobbed off.

    Only seven per cent of incapacity claimants are sick enough to stay on benefits for good.
    The results of new and tougher tests show the vast majority are either fit enough to work, or abandon their application half-way through.
    All fresh applicants for the Employment and Support Allowance, which is replacing Incapacity Benefit, must undergo the work capability assessments.

    The resulting figures, which will reopen debate about ‘workshy’ Britain, show that 39 per cent were found fit enough to take a job.
    A further 17 per cent were deemed able to do some form of work, with the right support.
    More than one in three dropped out in the application process and only one in 14 was too sick to undertake any employment.

    Just had the HCP around. Some of it seemed ok but it was just a box filling exercise rather than a medical assessment. Many questions were clearly leading ones but my partner did her best to stand her ground and tell the truth and not be led. Some examples were even after she told them that she didn’t cook (and why), he later asked 3 times more with phrases such as ‘so you can cook sometimes….’.
    Around 3/4 way through he was repeating some questions such as ‘can you get up yourself’ and as she sometimes can and sometimes can’t she replied ‘yes sometimes, at other times….’ and the HCP ticked the ‘yes’ box. After 2 or 3 of these questions I stopped the assessment and explained how inappropriate this was. He explained that he only had a yes / no box to fill in and he honestly expected me to then answer in a yes/no fashion!
    He became aggressive with my partner for a while and I stopped him as she was in tears and very very confused. He then said if he were to write down that she needed help with everything then they might appoint a full time carer for her (!). Thankfully this didn’t put her off and she just continued to tell the truth and not his preferred version.

    He was annoyed when he asked the question ‘can you turn in bed yourself or do you need help’. We kept repeating that my partner is only able to lie on her back and it is not possible for her to turn at all and so is impossible to answer that question. He kept saying that he needed to fill one of the boxes in !!!

    He was also visibly annoyed when we did not give an answer to ‘how many good days a month’ (as she has a wildly fluctuating condition and it is impossible to answer), and when I asked him to clarify what a ‘typical’ day meant in the context of her particular condition.

    At the end of it, we said the important things, didn’t say a lot of supplementary things (but these are in the appeal anyway) and in any case I am very unsure as to what extent things were written down that we did say.

    I guess they may be ok with single, more straightforward conditions, but their questioning, understanding and professionalism is not suited to anything more complex.

    I recorded everything and will look forward to checking their report.

    To anyone else undergoing this… Whilst I am sure I am not brilliant at this, my partner would have had no chance at all of making herself or her condition understood without me being there. Make sure you have someone present! Try also to have someone go through typical questions in a mock assessment beforehand, whilst you don’t want it to sound staged, it is *very* easy for you to say the incorrect thing in an assessment when you are being led by the HCP.

Thanks Dee…Just another day at the office for him, the moral is, if the question can only be answered as a positive or a negative then choose the one that suits you, for instance can you turn in bed without help from another person ? then you answer NO, and if asked why ? you reply I thought you said you can only write Yes or No ? so why do you want to know why I can’t turn over without help.

    If they are awkward then you get awkward but make sure it suits you, anyway could you let us know your result ? good luck..!!

    Very good luck. Try to record it (on your phone maybe ?) and ask for the assessment report afterwards and go through it to see if it is what actually happened. On my partners, he missed much of the medication off and hardly listed any of the side effects etc.
    Also don’t be pressurised into giving the answer you think they want. … and don’t give a ‘yes’ or ‘no’ answer if the answer isn’t yes or no. Forexample, ‘can you get up by yourself’ – my partner said ‘yes on a good day but usually….’ and by this time he had ticked yes and gone onto the next question.

So would I have to say depends on which day or not on a living dead day and go for negative first in everything. So essentially again this form is not applicable to someone with CFS/Fibro then. How can they not understand I am desperate to work, have done since I was 11years old. Tried and failed miserably for the last 5years. Even been handed on a plate a good business that I couldn’t do. dreading it. What a rant !!!! sorry

  88. You’re welcome. My partner is the same, she would love to be able to go back to work and has says she wished she was the person that the ATOS reports say she is. Try to tell him everything, give him time to write it down, If you think he hasn’t written it, reiterate it. (Especially the side effects part if this is applicable to you). If he says ‘the dwp only allow me to put yes or no’, say that he can annotate comments by the side.

  95. I had my WCA this week and it was absolutely bloody terrifying! The nurse doing the “examination” was totally condescending and patronising. When she noted I had attempted suicide on several occasions she asked me (verbatim) “And why haven’t you managed to kill yourself yet?” I was utterly at a loss for words but i wish i had “Frequently had episodes of disinhibited, aggressive or uncontrollable behaviour that would be unreasonable in any workplace”. Voila! 15 points. Instead i was so shocked I could only mutter darkly “That’s a VERY good question”.

    That’s like asking a termnal cancer patient why hasn’t the cancer killed them yet. absolutely bloody disgusting and as soon as i get some money I’m writing and complaining to my MP, ATOS, DWP, writing to my local paper and kicking up one bastard of a shitstorm! Pardon my Anglo-Saxon here but these fuckers need to stop their grubby profiteering at the expense of “The most vulnerable in our society”. Yeah, nice one Dave….

    I requested the HCP report and appeal form the next morning (I was surprised how quickly the DWP answered the phone! Ive got the appeal form but not the report yet.

    Your experience was par for the course and seems strange but as I indicated it’s actually very common.
    Anyway, get a sickline from your GP and fill in the GL24 form, mention you would like to be paid the assessment rate while you wait for the appeal to be heard.
    And when the ESA85 eventually arrives, fill it in (Take copies) and send it to the DWP and say here’s the rest of my appeal please forward it to the appeal service on my behalf.
    If they don’t then you will have a copy to take to the appeal service.

    There were a couple of TV documentaries aired in the summer one on Panorama and a Dispatches one, on one of these we were told that an HCP said exactly the same question as you had ie how come you aren’t dead then to a claimant who had severe depression and had attempted suicide several times. Unbelievable. Im surprised that one of these nasty HCPs isnt dead yet, but Im convinced the day of judgment will come! (with help from us all continuing to fight this evil system). Make sure you do complain to your MP, tribunal if it gets that far, etc etc. You can complain to ATOS as well but just be warned it might fall on deaf ears! What you might want to do now is write a diary of what happened at the assessment, all details, its not too late, but do it sooner than later so you can recall as much as possible and its still fresh in your mind.

If not my hand is up ooo employ me ,employ me ATOS because right now your organisation along with the Department of Dim Witted Prats (DWP) look like a bunch of idiots and has become a long standing joke in disabled people and their healthy family and friends culture! As I always say it is like Polar bears accessing a snakes need for heat, what the heck does a Polar Bear know!?! Am fed up of the normals doing disabled people’s jobs, bump these time wasters out off work and stick those who may need help dressing and ok need help in the bathroom etc but who have good empathy, good belief systems and more importantly knowledge of their client base! Only real disabled people can make a real impact on supporting other disabled people into work, we are fed up with normals taking up disabled assesment and advisory positions and these ridiculously subjective trivial Cosmopolitan tick box quizzes established by some bone head who no doubt has no idea of disability!

  102. The reminder letter dropped through the letter box this morning, from ATTOSSERS, and the bullying DWP.
    I have another 8 days to return the medical questionnaire, so i telephoned them to say that i am waiting for the latest letter from a hospital consultant, and also stated that i will be sending the big bundle by recorded delivery my Monday or Tuesday next week.
    With regards to sending them 23 years of occupational health notes, as well, would you send this lot to the DWP as well for the decision maker, or post to the decision maker if i have to go for a reconsideration or appeal?

    Can i also request to be seen by a DR, when i send my questionnaire off?, also has anybody on here ever asked the HCP Dr for their GMC registration number at the day of their corrupt medical examination.? and if so did that individual refuse to disclose the results.

A friend of mine has also taken her esa claim to appeal, she has now had her contribution based esa stopped and is appealing to go into the support group, they are up to their eyes in debt, she has now gone on to claim jsa, because she cant afford to live, would this put her appeal in jeopardy? would they stop the appeal going through?

    Send the lot with the questionnaire to ATOS when you see fit, just make sure it’s not over the Monthly deadline.
    if you are found fit for work by the DWP then they always ask when you appeal if you have any new evidence before they make their final decision.

    You can ask to be seen by a Doctor who specialises in your health condition, sometimes they agree and sometimes they don’t.
    You can also ask the HCP for their GMC registration number and sometimes they agree, but we have found that some of these chancers aren’t even members of the GMC.
    Therefore if they don’t agree then that can be a possible reason why..!!

    The DWP insist that it doesn’t affect your appeal if you sign on for work, all I can say is if I was sitting on a panel and having to decide whether a person is so ill they are appealing to get in the support group, then I’d be wondering why they can be so ill and still sign on for work.

    Of course the panel would have to know that one was signing on, and if the DWP don’t tell them in their part of the appeal submission then it’s academic, because obviously the appellant isn’t going to be stupid enough to tell them.

    But this is the question – do the DWP slyly tell the appeal service in their submission or not – as yet I don’t know.

    You need to tell us a little about yourself, are you appealing ? are you signing on etc.
    When were you assessed by ATOS ?, were you on income related ESA (Means tested) ?, or did you have enough national insurance stamps for Contributory ESA ?.
    You don’t need to work in a charity shop, there are things you can do like appealing and getting money and help etc.

  113. Have recieved notification from DWP that my wife is to be placed in the WRAG group from March 3rd.
    Strangely they have come to this decision without any input from our GP. I know this because my wife has been very il recently and our doctor has been visiting her at home. We asked him if he had been asked by ATOS/DWP for information about my wife and as of the 15th feb (when we asked )he had heard nothing!
    So I assume that the decision has been made without refrence to the GP and in another twist the the WRAG letter was dated the 15th as well!
    We are of course going to appeal as my wife is patently NOT able to work.
    Although how ATOS came to the conclusion WITHOUT a PHYSICAL assesment I will never know.

    On a lighter note have ATOS been forwarded to the HOLY SEE at the vatican for SAINTHOOD status as yet? I mean obviously if they can cure so many of disabilities merely by producing a miraculous cure letter then they are doing significantly better than JC himself..

    You have to laugh or they will get under your skin…

    Will let you know (miracle cures not withstanding) how our appeal goes..

I fully intend to ask the healthcare ‘professional’ just how long they have been specialising in mental health though, as I’m intrigued as to how I can walk, move my knees etc would have any bearing on a medical condition that three GPs agree on !!

How wonderful ATOSSERS are, i have just had a snotty email from them, with reference to my email complaint, i have had 4 letters from them in two days, the letter yesterday states, i am writing in connection with your request for a home visit, for your Employment sand support Allowance Assessment, unfortunately a home visit or taxi could not be authorized on the medical evidence we had received.
    The fact is i have never ever requested a home visit, or the use of a taxi, i only requested a change of dates, twice after they had given me dates where i was having Hospital procedures.
    I pointed this out to them that i had never requested the former, and that it was mentioned at their end,it is OK for them to use bullying tactics, but when it is turned back on them, they send snotty emails, they also asked me if i wanted them to send me a first class stamped envelope, so i could send the new medical evidence, i stated no thank you, as the envelope would not be big enough to send the medical evidence, but if they had a large envelope, yes please

I have seen a lot of comments on how people are treated at assessments, one person on here about the HCP saying ‘why have you not killed yourself then’ when she told the HCP about 7 suicide attempts. Let me tell you something ATOS and anyone else will not do anything about things happening like this. Even if you record it happening they will cover up every time or try to at all levels of complaints to everyone after ATOS they will not mention it in their report or they will down play it to what happened to you; but more likely not mention it as there is no evidence.

    In my case when ATOS IT investigated my complaints they said my scribbles in my ESA50 were offensive language and the HCP most probably was effected by this writing in my ESA50 AND staff should be protected from such abuse! The HCP had not said anything about the writing or being affected when I complained to ATOS at stage 1 and 2 and the investigating atos staff said nothing about swear words in the ESA50. IT ripped into me in their report and Independent Case Examiner said nothing about me pointing out that the wording was not swear words and ICE themselves attacked me in their report. At PHSO level they said that there was no swear words but the writing could be mistaken for swear words! PHSO did nothing about ATOS and ICE reports attacking me and making me look like the bad person.

    IT did this solely as the HCP had produced such a bad report they wanted to find anything to excuse what she did.

  134. hi all would it not be good to have a spy cam on your self when having this assessment and to show it on u tube or face book as i think it would be hard for them to take it off but the damage would then be done and then they could not dispute this , that is if you get all lies come back in your assessment as Ive had this trouble before with the doctors Ive got rheumatoid arthritis and when they came out to see me they said i could climb stairs OK and Ive got a bungalow never got of the seat; as my feet were swollen bad and then they say you can walk 250 yards, yes they all lie think its time for people to stand up against them but do it buy the book don’t go down to there level get evidence which they can not dispute all so we need more whistle blowers as they could well be the next ones on dwp it all so seems that we have these so called laws like discrimination acts, which they do not understand or have not been told about so hit them with a few of them, or disability act why make a law and not stand buy it, yes it is bad how people are treated; if we are this great country of people then stand up to them,but do it the right way use your rights against them

  137. I have had the dreaded brown envelope through the door this morning, with ATOSSERS , pack of lies,and have been put from support group status, to fit for work with zero points.
    I should of been given 15 points for the various accidents i have with regards to my crohns disease, but no mention of that,
    I sit here like many others in tears, and wonder what to do next?
    A definite appeal, i have notes taken at the assessment, as well as something else to add with reference to her blatant lies , the HCP that did my assessment, also told me half way through the medical that she had in fact worked with me, on a hospital ward, on quite a few occasions, and in my view a conflict of interest, i have already issued atos healthcare with a complaint about this, if she had of told me that she did know before the assessment, i don’t think i would of carried on with the assessment, due to conflict of interest.
    I was on contribution based esa, and in the support group, i have been told by the Guy from the DWP this afternoon, that i can put my appeal in and claim the assessment rate is this right? because i know that you are only allowed to be on contribution based esa for 365 days, and i have been in the support group for a year.after being reconsidered from the WRAG group,and put into the support group.in the whole i have been on esa for over two years, so how can i be entitled to the assessment rate, surely the Gentleman on the telephone from the DWP has got this wrong?
    I am now on no money what so ever, my husband works full time, so has to keep me, is it right that i can get the assessment rate on contribution based esa, while awaiting for appeal, when they have taken me out of the support to 0 points.

    First of all who told you that your Contributory ESA ends after a year if you are in the support group ? contributory ESA only ends after a year if you are in the work related group of ESA (WRAG) Yes I know it’s confusing, but you are forgetting that the support group means you stay on ESA for ever or until your assessed, then you should appeal and get the assessment rate.

    There are plenty of people on there who have been in your position and can give lots of tips and help, don’t mess around, get in there, go to the general discussion page and ask questions and get answers from people who have been there.

  141. I am waiting for a copy of the medical report and scoring card, then start going through the blatant lies that have painted myself as a fraud,
    I have got the paperwork that states, This is not a copy of your face to face assessment, just a basic report, and sumarises the complete apposite to what i am like on a daily basis, the HCP, stated that i can go out on my own, and can get to places, unaccompanied,complete lie, as i told her that i very rarely go out, and when i do there is always somebody with me, my Sister accompanied to the assessment, and i told the HCP, that i would not of managed to get there unaided.
    Another bit of the basic report states that i have no problems with my bowels, but yet i stated that i have up to 6 episodes of loose stools a day, and sometimes more due to crohns, and diverticular disease, resulting in accidents, where i have not managed to get to the toilet on time, i even told her that i had to wear pads, when i was really bad, she even wanted to know what pads i used, that should of been 15 points for a start, i am now going to write a letter of complaint to the NMC,about the lies she has told, which in a Court of Law is perjury, so i will give it a go and try and get her struck off, i will also be approaching a pro Bono Human Rights lawyer tomorrow.
    I scored 18 points last year, my medical conditions, have worsened since them, i now have zero points, so if the DWP consider me to be lying about my medical conditions, surely they have a duty to inform the Police that i am committing fraud, as well as the 5 hospital Consultants that i have produced medical evidence from, as well as over 25 years of Hospital occupational health notes, that show my appalling sickness record, WHY DID THE HOSPITAL TERMINATE MY NURSING CONTRACT LAST JULY? for being a picture of health, NO BECAUSE I HAD NOT WORKED FOR OVER 2 YEARS, as they had deemed me unfit for work, so basically all my Consultants are deemed as being liars as well.

  142. Hello Alison.

    The assessment has nothing to do with your health, it’s all a con to force you to appeal, everyone knows it’s a circus, the 365 MPs all know it’s a con and so do everyone at ATOS and the DWP.
    That’s what to do then, appeal and win, get your money back they owe you and wait for the next white envelope from ATOS. Get all the help you need here.

  143. I have now emailed a first level complaint, to atos regarding the HCP perjury regarding to her medical report,at my medical assessment, i will also be contacting a PRO BONO Human Rights Lawyer tomorrow, the same email, in letter form with be sent to the NMC council tomorrow as well.
    She also stated in the medical report, because i filled the ESA50 FORM in myself she is claiming that i do not have mental health problems and depression.WE ARE ILL, SUFFER WITH DISABILITIES, BUT ARE NOT THICK.

  144. Can you please tell me as to whether or not my DLA, will be stopped, while appealing or asking for a reconsideration, or tribunal in respect of my esa claim, i was in the Support group prior to their decision, in giving me zero points, with reference to my ATOSSERS medical assessment.

Alison you posting here is not being given its full attention has coming across to http://www.dwpexamination.org will help you more has there more like us who been through it and can get answers quicker so please come across it doesn’t cost a thing and yes they can and do by assessing you for esa claim can and do take away peoples dla theres loads who can testify it its a tory party acting just like hitler did getting rid off those who cost them monies so come across and your post will be answered quicker and by more just like us jeff3

  146. Yes Alison…the DWP use the fact that you failed the assessment for work to stop your DLA, but if you passed your assessment for work they conveniently forget about it and don’t use it in your favour.
    A bit one sided don’t you think ?.

I have just got back to receive a full copy of the medical assessment from May 1st 2013, the HCP stated in the report that i only managed minimal assistance to get on the couch, bet yes you have guessed it, due to stitches still being in situ from the biopsy,i declined, and she stated i got on the couch with minimal assistance, i have asked them for a reconsideration, just based on the preliminary report, the letter was sent by recorded delivery mail, i will now start and get all the paperwork together with reference appeal.
    I was told by a Man from the DWP, that i would not be entitled to the assessment rate, while awaiting for appeal, because i had been on contribution based esa for 365 days last May, and that was when i was placed in the WRAG group, i then asked for a reconsideration and was placed in the support group, which i was there until they gave me zero points on 16th May 2013, so i will appeal, but they are saying because that i have now been taken out of the support group, and not even in the WRAGG group, because my 365 days were up last May, after being on esa for a year, i cannot get the assessment rate, i person said that i can get the assessment rate, the other person said that i would not be able to get it because of the 365 day clause, who is right?

  148. I have had a letter from Customer Services regarding a complaint i sent them over a month ago, it involves the HCP that did my esa medical assessment,which is also now also in the hands of the NMC.
    The issues were very serious, so i asked my MP to investigate,he is also investigating the DWP.
    This is the letter that i received,
    Dear xxxxx
    I refer to my letter of 3rd June 2013,
    I am writing to advise you that your MP XXXXXXXXXTHE RIGHT HONORABLE XXXXXMP, has escalated your complaint regarding your employment and Support Allowance,medical assessment, with MS C xxxxxx on 1st May 2013, to the Department of work and pensions DWP.
    As a result, Atos Healthcare will not be responding directly to you concerning your complaint, as we have been directed to provide the findings from our investigation into your complaint, to the DWP, who will then arrange for a response to your complaint to be sent to your MP..
    I appologise for any inconvenience that this may cause, but do wish to assure you that your complaint is being taken seriously.TALK ABOUT PASS THE BOOK, i was assessed by a Nurse that knew me, and had previously worked with in the past.ATOS HANDBOOK FOF HCP, states that the HCP report should be impartial, concise and fair, so i have now used their guidance against them, i will now take this issue o the PRESS, when i get a few minutes, i will not let their miserly secrets be hidden.

    Could you please also clarify the following
    THE HCP MANUAL http://www.dwp.gov.uk/docs/wca-handbook.pdf, STATES THAT THE HCP medical assessments should be impartial, fair, precise and medically correct, so how can it be impartial and fair if a medical assessment is allowed to be done by somebody that the Service user knows, and had worked with at a hospital previously, as in my case.
    The medical assessment should be deemed void.
    MS XXX full medical report was full of untruths, and far from concise medical documentation,with reference her disclosure.
    Please answer this question.

    They tried exactly the same on with me… something along the lines of:- As ICE are investigating the DWP we will await their conclusions before commenting further.
    I told them in no uncertain terms that that wasn’t going to happen and they backed down.
    If they don’t, go back to your MP and get him to insist that they follow their own procedure … that is if you want them to do and not just leave it to the MP of course.

  153. I hope your husband asked ATOS for the assessment to be recorded Kazza, anyway don’t worry, if the worst comes to the worst he can appeal, after all that’s the whole point of these bogus WCAs, to deliberately find one fit for work and force people to appeal.
