I am becoming more and more concerned at the way in which the ATOS “Doctors” are operating. As employees of a private company, employed by our Government to asses our capability for work, I assume they are still required to operate within the same parameters of the NHS. They are allegedly “Doctors” and as such must have taken the Hippocratic Oath during which they promise “first do no harm”. From information received recently, this does not appear to be the case, I am sure, as human beings we have rights under the Human Rights Act which protect us from harm as well as any other Oath any “Doctor” will take once they step onto the path of medical training.
When we attend the “Medical” examination at our local ATOS medical centre, we are entitled to be treated fairly and equitably by the examining Healthcare Professional? I think so and therefor, it must follow that their methods of operation must also fall into line with those used by my beloved NHS. This being the (assumed) case, then the “Doctor” should be kind, courteous and aware of our potential health issues and the possible ensuing pain when we are examined. One would also imagine that the rapport between “Doctor” and claimant would be a two-way process as in normal communication, where the “Doctor” will ask a question, listen carefully to the claimant and then make a judgement as he is supposed to do. It therefor also follows that the “Doctor” will not try to trip the claimant up by asking the same question in a slightly different manner several questions later, just to confuse the issue. The “Doctor” should not make idle threats, shout, or become overpowering in any way shape or form, we should not be asked to climb up 2 steps to get onto a medical examination bed which is fully adjustable, regardless of what they tell us. We should not be asked to repeat a demonstrated movement then be instructed by the “Doctor” to “Just lean on the edge of the desk if it helps you” when he didn’t during the demonstration? it defeats the object don’t you think.
I suggest that we make sure our answers are correct, that they are received correctly by the “Doctor” and that those answers are recorded equally correctly by the ” Doctor”. It is our right to be treated fairly and in a kind and courteous manner and to have the answers we give interpreted correctly, not twisted to suit what the “Doctor” thinks best fits his multiple choice answers. I also suggest we make sure we do not fall into the trap of “Just leaning on the edge of the desk” etc, its theer way of justifying the use of terms like “does not fit with available evidence ” in their reports to the “Decision Makers”
It is because of this system that we are suffering at the hands of these charlatans, who blatantly ignore the obvious and carry on regardless no matter what we say to them. It is time to fight back and ensure that we are heard during these alleged personal capability assessments, they are an insult to our intelligence and should be treated as such. If you feel you have been mistreated in any way, then it is your right to complain, and I urge you to do so profusely. I also urge you to back up this complaint with a letter to the British Medical Association and to your M.P.
Lets take the fight to them, let’s make their lives as much of a misery as they make ours, question everything you feel is wrong. Do not let these fools ride roughshod over our rights as human beings, demand equitable and fair treatment and if you don’t get it, shout about it.

yes what you say is true we never asked to be ill or disabled if by choice we would rather be fit and healthy but as through time we fall by the wayside have accidents that affect us all in many ways i do think that under those fools of so called doctors that our human rights are being violated as firstly it is not a medical examination in our intrest but only for a goverment that is obsesed with keeping the rich elite in favour and the torys want us back to victoran times where the common man\woman had no rights so it has opened my eyes with the true meaning about camerons big society as i did not see what he was planning yes i to believe we should fight them with our right to fairness and not to be used by the goverment to repay their years of mismanagment the labour party as well so as a partly disabled man myself i had to fight for years to get dla as i had loads of problems with my legs and a few other ailments to get my case won just 3 years ago for the torys to take away again under very unfair means and rulings i wonder if i was disabled and quit very well off and a tory party member would they be treated the same i dont think so please spread the message to all the truly disabled and to fight with all their means to rid us of this tory goverment who treat folk with utter contemt do not vote them in ever again as the torys are not interested in us but only the people with money and the lib\dems they as far as i am concerned like the torys they dont and are not needed in this country our our lives so please i dont know how to but get as many people to help get rid of this coalation of a goverment for good with thamks pmac from edinburgh……………..

i also agree about the torys i think its about time cameron was removed from the seat along with the rest of his party since they have been in power they have cripple this country all they seem to think about is there own pockets im on dla at the moment for epilepsy but are due up for the medical in two weeks time so i dont fancy my chances by what i read on here now i wonder how cameron would feel if he had to claim dla and join the rest of us who have got to fight for what we should be entitle to so come on everyone lets all stick together and show the torys we are not door mats

If you are found fit for work then you can get help here http://dwpexaminations.blacktrianglecampaign.org/phpBB3/ and as for how Cameron will feel if he had to claim DLA well you may be surprised to learn that he already has claimed DLA on behalf of his son, only difference between him and you is that he didn’t need to fight to get it.

The social fund is being scrapped in England – the social fund provides community care grants (used by the disabled, elderly and children coming out of care) and crisis loans (which are paid back)
I wrote to the minister for the DWP and asked how many people in England got crisis loans. In 2009 over 2.69 million families in England got crisis loans (one off loans to help meet unexpected costs – with every penny paid back to the DWP
e.g. your child is taken in to hospital with cancer- this loan helps those on low incomes cover travel expenses and the extra expenses a crisis like this brings
Your home is flooded, a bad winter and you can’t afford the entire electricity or gas bill
Now if over 2.69 million families made use of crisis loans in 2009 (in England alone) and paid them back – what are they to do when Cameron, Clegg and Co abolish them
Well King Cameron and King Clegg have decided to advise councils to send people to foodbanks, especially the Trussell Trust, who just happen to be chaired by the Tory Mayor of Worthing
So when you are sick or disabled, pregnant or your child has cancer or your house gets flooded or your husband dies and you need a little short term help – there will be none available
In fact the Tory/Liberal coalition has decided you must use all your resources to pay for the crisis and as they know you won’t have money left for food – you can go to the new Tory Mayor controlled Trussell Trust -
You can get a parcel of food with no fresh food in it – you must trample for miles to get it and when your are sick, disabled, pregnant, a pensioner – then you must carry this food parcel yourself for miles – you won’t be allowed to get a loan to buy fresh milk, fresh bread, fresh fruit and veg or fresh meat – powdered milk and powdered potatoes for you and your children (no doubt Cameron will bring back powdered eggs too)
Now you will go cap in hand and say “please Mr Tory Mayor – may I have some powdered milk. Please sir, can I have powdered potatoes – and IF the Tory Mayor of Worthing decides you can be granted a food parcel then you can shuffle in line with the 2.69 million other English families who are now to be denied a little short term help and their dignity.
But here’s the catch – you can only get 3 parcels of powdered milk and powdered potatoes – no longer can you be trusted to handle money and pay it back – no the Tory party should decide WHAT you get to eat and IF you get to eat
And as for community care grants – well there is a company who collects household bulky refuse on behalf of councils – now the elderly, disabled and children coming out of care have to go along to this refuse collecter and furnish their homes with other people’s rubbish
The disabled and the elderly will no longer get grants to help them adapt their home as they require – now the elderly are on their own – as they become infirm they will no longer get grants for handrails and disability aids – now the Tories and the Liberals say they have cured infirmity and these aids are no longer required (just as Athos perform their daily miracles and make the blind see and the crippled walk and the cancer sufferers tumours disappear
2.69 million English families will now be denied the funds they are legally entitled to – to help meet the massive cost of winter fuel bills -
Crisis loans cost us nothing – every penny is paid back
Now if your child gets cancer – you can walk to the hospital
Now if you have a crisis – Clegg and Cameron will make you line up with cap in hand for a food parcel from a Tory Mayor
Any funds given to councils will not be ringfenced – so if a Tory Council wants to get nice new offices – well they can use the money meant to help not just the poorest in society – because everyone who is working can apply for these loans if unexpected crisis happen
Now if we can’t get crisis loans to help with the cost of winter fuel bills – we will queue up at foodbanks – to get food we cannot cook because we cannot meet the cost of fuel
So we will stand at big society brazier banks
And as we are no longer allowed to buy fresh bread, fresh milk, fresh fruit and veg and fresh meat with our crisis loan – malnutrician and rickets will come back – costing the NHS hundreds of millions
And as 2.69 million families stand about the brazier banks we will hear – please sir can you spare a dime

My husband was assessed by Atos professional medical practitioner employed by the DWP department in Aberystwyth. My husband suffered with a lung disease called Sarcoidosis, which then leads to pulmonary fibrosis, which then can lead to heart failure due to the pressure the heart is put under due to the lungs not working properly and gasping for breath. This is what my husband had, yet he was assessed as medically fit for work and did not receive any money or benefits which is what they like to call it, until after he died. What benefit is that to someone who is dead? I want to find out what qualifications this man has got to assess my late husband as fit for work, he was not fit for anything never mind work. If anyone can help me find some information on this man then I would be most grateful as I cannot seem to find anything at the moment on the computer regarding this so called doctor Ian Wilson, medical professional practitioner. If for instance he was a qualified practitioner, then surely he would have some knowledge on sarcoidosis, clearly not, as he stated on my late husbands report (over time the client will improve in health with the right medication and treatment), well how wrong can you be, my husband ran out of time thanks to him, putting an enormous amount of stress financially on top of his illness did not help him one bit. As my late husband and myself have worked since leaving school, paid our taxes and national insurance and never once claiming any benefits from the government, I feel it is pay back time. My husband was 53 years of age and leaves two sons, one who is only 13 yrs old. I intend to fight this and I will do it for my hard working, kind and caring husband.

You could make a start by finding out his reg number and looking up the GMC website and see if hes registered to practice in Britain, ATOS employ DRs and Nurses who are not licensed to practice in Britain, and so does the NHS it’s unbelievable but these people are a law unto themselves http://www.dailymail.co.uk/news/article-2116878/Danger-doctors-ignoring-sanctions-practising-powerless-GMC-fails-police-bans.html and so it seems the General medical council can do nothing about it.
Ian Wilson is an extremely common name in Britain, I wouldn’t be surprised if their was at least a dozen Doctors maybe even more so named in Britain, that’s why you need that Number.

I got a copy of my medical examination report today, it has took them over a month to gratify me with their disclosures, got most of my files under the data protection act as well.
I have just over a week to comply with their deadline for appeal, but they did say, because it took them nearly a month to send the document, i may be allowed longer to submit my files for appeal, if appropriate.
The report was on the whole very fair, but with quite a few discrepancies.
The HCP stated that she did not check my blood pressure, or do any other examination, because she didn’t feel it appropriate due to my visible severe abdominal pains, due to crohns disease, bowel adhesion’s, and gynecology problems, nothing was ever mentioned about checking my blood pressure, or any form of physical examination.
She wrote that i have no problems with my mobility which is untrue, because i suffer from RLS, and often have sciatica, due to spinal atrophy.
I have been placed in the WRAG group, do you think it is worth me appealing against this, to get put into the support group for the time being, as i have new medical evidence to support my present problems, based on a recent hystroscopy?
They delayed in sending me a copy of the medical report, but were very happy to give me a date for an interview at the job centre in two weeks time, at 8.30am in the morning, which is a no go with how i feel at the moment post procedure, another appointment was agreed later on that week at 10.30 am.
If i appeal against the WRAG group to get put into the support group for the time being do you think that my benefit could be stopped altogether, and the Tribunal finding me fit for work?
I have a job to go back to?

There was no points system found visible on the copy of my medical report, where would i find this?

Hello Alison.
To get ESA, any kind of ESA then you have to get 15 points, that’s the law, some people are just getting letters saying they are granted ESA but the WRAG hoping they wont appeal to get in to the support group.
You should ask the DWP for the score sheet, that tells you how many points you were awarded and how they were made up etc.

You have taught me so much thank you thank you, if i decide to appeal, will do it as litigant in person.
THE DWP ARE AS BAD AS SOCIAL SERVICES SO I HAVE NO FEAR WHEN I DEAL WITH FAMILY COURT CORRUPTION ON A DAILY BASIS.
My co workers are doing all the leg work with regards to that while i am ill.

Don’t they usually send the score sheet with a copy of the medical report?
I guess the client should always ask for this, as they have got no brains between them?
Do you think i should appeal, as i am frightened of loosing what i have got
The HCP was a Nurse, i feel that she is not adequately trained to deal with crohns and other long term gastro conditions.
By the way they have sent me another limited capability for work questionnaire form to fill in, but no letter to state when it has to be back to them by, don’t know if they have done that in case i appeal.

Does anybody know if there is a legal issue with this new “limited work” test, and people who have been medically retired for life by their employers ? I satisfied the trustees of my ex employers that I would no longer be able to carry out any kind of employment, I also have been classed as incapable of working by the DWP for the same amount of time which is some 16 years, now i’m told i must go for a medical assessment, ive been told by the pensions ombudsmans office that if the DWP now say i can do some form of work i will lose my ill health retirement pension, but to come back to them if that happens….I just can’t believe that this Government can get away with this…does anybody know of anything that may be able to help me ? I’ve two GP’s, one was angry that I’ve been told i must go through the medical process after he had confirmed my illness’s etc that was sent in with my completed form. thank you in advance.

That’s the reason why I asked if you are on Contributory ESA WRAG, they are going to stop it after a year and it’s retrospective as well, but they can’t touch you if you are in the support group, that’s why you got ESA without a fight.
Yes you can see the reason and you must appeal to get in to the support group, so get as much medical evidence and appeal.
You have to ask for the score sheet because they give you nothing if you don’t ask, you can understand now why we are fighting these bastards for all we are worth.

So, nobody here has had the situation where that if they are now told they’re” fit for work” that it conflicts with their ill health retirement pension ? I’m refering to those that have been medically retired by their employers and have been entitled to incapacity benefit too. surely, this Government can’t think they can make up new rules that completely conflict with those that have been medically retired for life ? I see major Sh*t hitting the fan for David Cameron..
