Well, this is it readers. As I predicted, the Department of Whinging Pennypinchers has stopped my benefits. No surpprises there then eh? All I can say is watch this space for a blow by blow account of the battle between me and my nemises.

  1. best of luck for your appeal.

    I have my medical in a few days. Do you know how long after your medical they stopped your benefits? I am preparing for the worst, but am due a benefit payment a week after my medical and am wondering if that will be stopped or whether it will be the one after- it makes a lot of difference to me as I am very low on money.

  2. My benefits were stopped exactly two months almost to the day resulting in an overpayment which I challenged. I have heard stories wher it has taken one month though. Good luck and if they do stop your benefits go to your local CAB or Local Authority social services to see what you can claim, even if it is JSA. Ensuring you have something to live on and to continue any housing benefits is not an admission that ATOS were right, it is simply a stop gap action so you dont end up in court or homeless as some folks do. Make your appeal and get help with it if you need it, Tribunals are totally impartial and often overturn decisions especially if you come over as a credible witness who genuinely has need of thier benefits. If you win then the status Quo should be restored but with the deduction of any other benefits claimed between suspension and successful appeal. Good luck and let me know how it turns out.

  3. thanks for your reply. Finding your website has been a godsend to me. If I hadn’t found it I would have bumbled along to the medical completely clueless.

    my GP says that if I don’t get through the medical “he’s pretty sure we can win the appeal”- just not sure I can afford to appeal.

    anyway, judging what happened to you it will take them a while to stop my benefits. financial worries are not what I need on top of my mental health problems.

  4. Look at it this way P, if they do stop your benefits, and you do have to claim JSA its not an admission of guilt. You are forced to claim JSA as you have no other choice. When your appeal is heard I am sure you will be vindicated and the DWP will be forced to restor you to your original benefits before they took action. Try not to let it get you down, dont be pessemistice either but try to have an emergency plan of action in case you need one. Remember, the DWP will continue to pat ATOS on the back if we dont stand up to be counted by appealing against these foul decisions.

    my only worry (well not my only one lol) is that when you claim JSA you have to state that you are fit for work- won’t that count against you in the appeal?

  6. i had my medical today and after all my calculating and planning I just decided to be myself and not pretend. Sometimes we are so scared we think we need to pretend. But just be yourself.

    The doctor said she did not have the final decision but that she was recommending a review after 18 months, meaning I will keep my benefits.

    Fingers crossed all goes well for you, but do not think that just because that was said, it means you will pass and keep your benefits.

    What they say to you is in my experience, meaningless and should be treated with a large bucket of salt.
    At least that has always been my personal experience.

    Please let us know how your case goes, hopefully it will go well, but dont count your chickens just yet.

  8. You must wait for the decision to be certain, I dont want to rain on your parade but I was given some similar drivel and still had my benefits stopped. I appealed successfully and the alleged Doctors and the decision makers opinion was massively overturned by the tribunal. Good luck and let us know the outcome.

  9. I have never claimed another or replacement benefit so cant comment. If thats the case then surely it simply reinforces what I and many others are saying in that if you are forced to claim JSA are yu admitting by default that ATOS and the decision makers are right? surely thats fundamentally wrong and our Government know it. I am moreworried about you and the effect losing benifits may have. I would rather try to make a claim and prove the fools wrong at a tribunal than risk homelessness and poverty. God only knows there are already many unfortunate people in that position already.

  10. hi there, i just been reading what you have wrote on the site, i went for a medical yesterday, and its like your doomed to fail, as this so called doctor never asked me about the main problem why i can not work, i kept mentioning it and he was talking over me , asked me to move my arms about like in a child in a nursery school, and never never once asked or wanted to examine me, was a complete waste of time and i thought what was the point, i felt cheated and do not no what to do about it, why do they not want to know or talk about the real problems , thanks where can i complain about this bogus company,tried to ring atos for to complaine ,can not get to speak to no one ,this medical was a joke, thanks

  11. Yes J, they do that. Its the only way to go for them, if you are too ill to work, more often than not there are secondary illnesses or infirmities caused by the main reason for your sickness/illness/disability. The fool I had did the same with me, he chose to deliberately ignore the fact that I had had major surgery within the five months prior to his alleged “examination” which they themselves admit is not a “normal” examination. He asked about things which he could easily dismiss, that way, just like Mengeler and his cronies during the war, they can truthfully say thier findings are based upon fact. The real fact is that these fools are deliberately ignoring the disabilities claimants have just to meet targets. I am going to carefully word my next 1b 50 or whatever it is they send us now and see what happens. Ill try to keep you posted but its quite difficult for me at the moment and updating the blog has become a low priority i’m afraid

  12. Just got my decision through the post 2 weeks after the medical. I am ok, and can stay on IB for 18 months with no sick notes.

    I have to thank you for this site. Altho I was totally honest at the medical and was just myself, reading this site stopped me from walking headlong into the traps they set.

    Would it help if I wrote an account of my medical/ the centre?

  13. First may I congratulate you on the approach you have taken. Honesty is always the best policy and because of this, bad decisions by alleged “Doctors” will continue to be overturned by Tribunals. Its good to hear a positive result for once and as I said I am quite willing to give credit where it is due. In answer to the latter part of your missive, yes, a full account of your medical and a description of the centre as well as its location in relation to parking and walking access will be much appreciated. The more we have the better off we will be. Well done.

  15. I had my Atos medical last Friday, and my payment is due to be payed on 19th March.
    I have rang the DWP on arriving home and told them i wanted a copy of the medical report, they have noted this on computer.
    I have to go into Hospital tomorrow for emergency surgery, the new medical evidence was submitted to the HCP at the time of the medical,she looked like she was tapping the information into the computer, but knowing their history it will not be mentioned.
    I rang the DWP this afternoon, the Lady said that they had not received the medical report yet,i told her that the report had been faxed through to the DWP but she was amendment that they had not received the report yet.
    I asked her if i was going to be payed on Monday?, but she was unable to tell me, but she said if i was getting paid, there would be notification now if the money was going to be released.
    SO I GO INTO HOSPITAL TOMORROW FOR AN OPERATION STILL UNCLEAR AS TO WHETHER I WILL BE PAID OR NOT.?
    I CAN SEE WHAT WILL HAPPEN GET HOME FROM HOSPITAL AND RECEIVE THE DREADED DEED OF A LETTER FROM THE DWP SAYING I HAVE FAILED THE MEDICAL KICKED IN THE STOMACH TWICE OVER.
    I WILL NOT BE STARVING MY HUSBAND WILL SUPPORT ME, SOME OTHER PEOPLE ARE NOT THAT LUCKY.
    ANY ADVICE PLEASE.

  17. Hello Allison, you seem to have it all worked out, you have every right to be suspicious, in your heart you know they are going to find you fit for work and that means no captain cash.
    The very best that can happen is they send you a letter saying you can get ESA but only the Work related variety, which is totally ridiculous considering you are going in to hospital, so then expect the worst anything other is a bonus.
