Why we must continue the fight in 2012

Happy New Year readers

I would like to begin by wishing all of our readers and contributors a very happy, healthy and prosperous new year for 2012. The last year has been tremendous for the blog and our sister forum, those of you who wish to read the stats for the blog in 2011 can do so as they have now been published on this site.

Here at DWPexamination my co editor Joe Blogs and I hope to raise our profile even further this coming year. We can not do this without your help and ask you to mention the blog and the forum to your friends and family. Our aims are clear, we have and will continue to fight the proposed changes to benefits and the insidious attacks on the weakest in society by this shameful Tory led sham of a Government.

Without the pressure applied by ourselves, black triangle and many other disability rights forums and blogs there would never have been a “Harrington report”, the welfare reform Bill would have sailed through Parliament with its ugly sister the Health and Social Care Bill which will no doubt cause mayhem in the NHS, fragmenting it and allowing the private sector to cherry pick the best parts for themselves.

We must continue to work together to oppose any changes which will have an adverse effect upon the weakest in society, benefits and the NHS. Make no mistake, we want a fair and equitable test, one which recognises disability, one which focuses upon the individual case rather than a profit driven benefit denial “one size fits all” exercise.

To achieve this ATOS have to go, they must be replaced by a not for profit British organisation keeping the investment in the process and people within theUK. To achieve this we must continue to keep the Government and responsible Ministers under constant pressure. We must be heard, we are tax payers and voters, we put these fools in a position of power by default, they have no mandate to act as they are and that is where we have the power. They must remember we can take their power away from them.

If we spread the word to other disabled people around us, tell them what is really going on, tell your families and friends that we are fighting for their future rights to benefits too. Tell fully abled people that they too could fall foul of disability or illness at any time, tell them of the long and arduous journey ahead of them and the continuing fight to retain their rights to benefits once they have them.

We need every disabled person in the country to rally to our cause. We can and will win if we stand united.

  1. yes your right we should all stick together and fight for our rights but what do we all do, nothing we all talk and sit back and let these tories walk over us.what we should be doing is like the council done a few months ago when they were protesting in london,im surprised this nut case cameron hasent got riots on his hands with what he is doing to this country perhaps this is what he needs so that he gets the message from people.i think he should be out of power

  2. Hello Paul.

Well we have been doing something, helping people to understand this nonsense that is ESA, ATOS, DWP etc.
For three years we have been doing it without much support, and I will remind the reader that we don’t ask for a penny, and we don’t want anything, in fact it costs money to set up a site like our sister site link below, there’s far to many people coming here and our sister site http://dwpexaminations.blacktrianglecampaign.org/phpBB3/index.php sucking up all the information they can get and then resting on their laurels, thumping their chests and congratulating themselves that they got up of their backsides and found information that helped them win appeals etc, then they disappear, that is until the next ESA 50 arrives on their doorstep.

This information didn’t just appear from nowhere, it was researched with a lot of hard work, but it seems that most people who are on sickness benefits don’t want to do anything in the way of help, they just want to talk about it..!!

  4. Hello Paul.

The public are not doing anything about it because it’s not happening to them yet, most of them are not experiencing the hardship yet and when they do get the message it will be too late.
That’s why we/you must help and take action now, an e-mail to your MP expressing your dissatisfaction would help, so would showing solidarity by joining an anti-ATOS/DWP forum.

  5. hi

yes your right atos have just sent a reminder letter to me today so you can guess what the next step will be i just wish i could get people to stick together and stand up and fight for there rights.but i must say that it doesent help when you have got people claiming benefit when there is nothing wrong with them its the genuine people thats got to suffer for it and cant get the benefit.if i fail the medical the cab said they would take it to court but i dont know if i could get a solicitor to fight the case for me rather than have the cab do it

  6. Hello Paul.

People are sticking together, here at the forum, http://dwpexaminations.blacktrianglecampaign.org/phpBB3/ just pick a username and log in and get help and information to combat ATOS and their partners in crime the DWP.
The CAB to represent you is a great start, there are people out there with no one to represent them at a tribunal, if you do fail the ATOS assessment then take heart that you are not alone, at the forum we can show you what to do next, how to appeal, what to do for money while you wait for the appeal etc.

Paul I’m just sending my ESA 50 questionnaire on to ATOS tomorrow, so I will be in the same boat as yourself, I’ve been there four times already this is my fifth time, I’m long past worrying about it, I left all that worrying nonsense behind me two years ago..!!

  7. hello

thanks for that but how have you done without money? why have they failed you four times i have heard that the goverment do pay atos so much to failing each person just to get them off benefit i dont know if thats right but it wouldent surprise me nothing surprises me with this goverment.the thing is with this goverment they take off the poor to give to the rich and at the same time feed there own pockets

    Comment by p.oakley — February 28, 2012 @ 9:52 pm

  8. Hi Paul.

They failed me four times in a row because it’s a fix, a mad attempt to try and force me to sign on, all they have done is made me more determined..!! I didn’t do without money, I claimed the assessment rate while I waited for the appeal to be heard..!!
ATOS do get a bonus for every person they deliberately find fit for work, I don’t know how their bonus system works Paul, but someone commented on the Daily record that they get an extra bonus of £35 for each ESA claimant they find fit for work and £55 for each DLA claimant they find work fit..!!

  9. WAKE UP PEOPLE
what we are seing is a massive shift of wealth from the ordinary person and the poorest of society to the mega rich

Every one please write or email your MP NOW TODAY and let them now that you will not vote for their Conservative or libdem candidate at this 3rd May local election unless they imediately stop the ESA medical assessments,
use your own words but dont hold back but be polite.

  10. Hi Funky, we have been fighting the previous Government, this one, the DWP and ATOS for the last 3 and a half years. We constantly put the Government ministers and our own MP’s under pressure and will keep it up but I’m afraid this one is down to the collective consciousness of the British public. We created this hell of a coalition and only we can end it but just who do we vote for? do we take a chance and vote Labour? will they just pick up the baton from the present lot and continue the way they are going? no one knows, I cant predict what a future Labour Government will do but I know one thing, I don’t want another 5 years of this hell we have now and that’s what we are looking at if we don’t vote Labour. Maybe better the devil you know is our only option because if we get another 5 years of this lot , you, me and every other sick, disabled or unemployed person in Britain face extinction or a future doomed to stacking shelves int he local supermarket for benefits.

    Cheers

    Nelson

  12. Point is if we dont vote labour (and most people dont want to anyway because they are as bad as the Tories) we end up with more of the same. We need to be rid of the condems for good and that unfortunately leaves us Labour untill a fourth party comes along and I suspect that wont be too long.

  15. i think our fight should be taken to the courts of human rights the old sick and injured and being victimised by nothing less than a dictatorship after looking at the sparticus report i feel we can get more constructive action going down this road before cameron rewrites the human rights to suit himself

    Comment by head56 — April 22, 2012 @ 2:18 pm

  16. Hello head56.

I appreciate what your saying but I think you will find that just going to the human rights is not possible, first of all a person has to go through every local complaint procedure until they are exhausted, in other words jump through every hoop, then and only then can an application to the human rights be entertained.
If it was simple to just go to the human rights court then Tony Blair would never have signed up to it, he knew it takes years sometimes and a lot of work before a person can get anywhere near it.
NO the European human rights court is a long long hard road, make no mistake about that..!!

  17. Well I have had my appeal rejected. I think their minds were already made up and they heard me due to the fact that I turned up. With crunchy knees (surgeons words) and lower back Osteoarthritis has been diagnosed. Also Type 2 Diabetic with severe depression and anxiety. I cannot sit or stand for too long and walking is painful but if I am medicated up to the eyeballs and trying not to fall asleep I can manage a small walk. I have been struggling on reduced rate ESA and have been issued with another sick note from GP. My daughter has to help me wash my hair sometimes also with my socks and especially looking after my toenails as I cannot get down there…..what do I do now. I am gutted and at £260 a month to live on its so difficult. Just feel like ending it all to make them happy.
